Request an Right-of-Way Use Administrative Review

Portland City Code gives you the option of requesting a modification to some Transportation decisions through an administrative review by the Transportation Enforcement Program Manager.

The City of Portland tries, when possible, to resolve issues with customers. If you have received a letter or notice from the Bureau of Transportation, you may use the information on the notice to contact Transportation staff to discuss the issue. 

How and When to Request a Review

To request a review, download the Administrative Review Request Form (below), fill it out and return it to the contact person listed on the letter or notice you received from Transportation.

Review Fee

The requestor must pay a fee prior to commencement of the Administrative Review and per the adopted Fee Schedule. Include a check made out to the City of Portland. This money will be fully refunded if the review does not find for PBOT.

You have 20 days after your letter or notice was sent to submit a request for administrative review.

Decisions That Are Not Reviewable

Most Transportation decisions are reviewable, but the decisions listed below are not. Transportation will deny requests for review of these types of decisions:

The city’s authority to regulate/ charge fees or penalties/ impose liens

Transportation technical standards: content or requirements of the applicable policy

Matters subject to the authority of another appeal body (i.e. land use decisions, etc.)

City Council-approved charge rates (includes System Development Charge rates)

Approval/denial of design exceptions

City’s choice of method or cost for addressing emergency situations or declared nuisances

Code Hearings Officer

After the administrative review is complete and you have received a Final Determination letter from Transportation, you may request an appeal from the Code Hearing Officer for subjects that were discussed in the administrative review. Go here for information on the Code Hearings Officer process.
