Updates to TRN-9.02 (Transportation Demand Management (TDM) Plans for Residential Uses Administrative Rule and Procedures Guide).

The Portland Bureau of Transportation (PBOT) is proposing two changes to TRN-9.02 (Transportation Demand Management (TDM) Plans for Residential Uses Administrative Rule and Procedures Guide).

1. Simplify the prioritized uses of the Multimodal Incentive Fee. While the goal of this fee is to distribute multimodal incentives to residents, the rule stipulates the order of use for unused funds. Under the current usage prioritization, funds have remained unused, and the proposed language is intended to broaden the availability of funds and better meet PBOT's Transportation Demand Management goals.
2. Eliminate the TDM exemption for new commercial/mixed-use or multi-dwelling zone developments with more than 10 units located far from transit. This change aligns with state requirements to remove or reduce minimum parking requirements in urban areas and updates the Administrative Rule to changes already made in Title 33.266.410. This change means all new developments with more than 10 units in these zones will be subject to TDM requirements, regardless of their proximity to transit. This change supports the City's objectives to reduce reliance on single-occupancy vehicles and promote alternative transportation options.

Portland City Code Section 3.12.010 establishes the authority of the City Administrator to adopt administrative rules.

Changes to this administrative rule are anticipated to go into effect 30 days after adoption.

Per PCC 1.05 and TRN 16.01 – Administrative Rules and Procedures, PBOT is publishing the proposed administrative rule for 30 days of public comment. PBOT will be accepting public comment for this Tier I update until 5 p.m. on March 20, 2026. Comments on the proposed update may be submitted to pbotpolicycomments@portlandoregon.gov. A summary of comments received and the City's response will be posted below.
