The Portland Bureau of Transportation (PBOT) is proposing to update TRN-8.14 (Right-of-Way Enforcement Program). This rule describes the bureau's procedures for assessing violations of PBOT administrative rules and certain permits.
The proposed updates 1) shift PBOT’s focus from “enforcement” to gaining “compliance" and 2) clarify Class I and II violation classifications.
These updates clarify the reach and scope of the enforcement program and what the response to violations will entail. While civil penalties such as fines or abatement are available options, the primary preferred outcome is voluntary compliance through outreach and education.
Per TRN 16.01 – Administrative Rules and Procedures, PBOT is publishing the proposed administrative rule for 30 days of public comment. PBOT will be accepting public comment for this Tier 1 update until 5 p.m. on October 17, 2024. Comments on the proposed rule may be submitted to pbotpolicycomments@portlandoregon.gov. All comments received will be reviewed by PBOT staff and posted below.
