On Feb. 24, Zenith Energy appealed the Oregon Land Use Board of Appeals’ (LUBA) decision on the City’s denial of Zenith’s Land Use Compatibility Statement (LUCS) to the Oregon Court of Appeals. We expect to file our response to Zenith’s appeal in the coming weeks.

Court challenges can take time. Because this matter is now before the Court of Appeals, the City cannot take further action on LUBA’s decision until the Court issues its decision. 

Portland City Council stands united in affirmation of the City’s commitment to a clean energy future, addressing climate change, and reducing our dependence on fossil fuels. It is time to stop kicking our declarations down the road of intention and start acting with the urgency needed at this critical time in history. We know that the activities carried out at this site and the fossil fuel products being transported have the potential to directly impact tribal territories, cultural resources, and tribal treaty rights.

The City of Portland looks forward to making our case to the Oregon Court of Appeals.
