Notice of Permanent Administrative Rule - Transient Lodging Facilities

The purpose of this administrative rule is to guide implementation of Chapter 24.31 of Portland City Code. This chapter governs transient lodging facilities within the City of Portland.

In December 2024, the City Council approved amendments to Title 24 Building Regulations. These amendments give Portland Permitting & Development (PP&D) authority to regulate transient lodging and enact rules to establish minimum fire and life safety construction standards.

PP&D published Interim Administrative Rule ENB 13.03, Transient Lodging Facilities, effective Jan. 1, 2025. The public is invited to provide testimony on the interim rule prior to its permanent enactment. The permanent administrative rule is expected to take effect on June 23, 2025.

Public comment on this draft closed on June 9.

Summary of comments received

Portland Permitting & Development received one comment on the proposed update to Administrative Rule ENB 13.03, Transient Lodging Facilities, about reducing fire safety standards to promote development. Fire safety is the primary goal of this administrative rule. It was written in response to Ordinance 192004, passed by the Portland City Council, to amend Title 24 to regulate transient lodging and write administrative rules that establish minimum fire and life safety construction standards.
