I. Purpose 

This rule further defines Administrative Suspensions outlined in the following sections of Portland City Code (PCC) Chapter 16.40:

  • 16.40.470.E.6.a
  • 16.40.560.E.6.a 
  • 16.40.670.E.6.a
  • 16.40.770.E.7.a 
  • 16.40.810.G.6.a

II. Regulatory Authority 

The authority to adopt this Administrative Rule is provided by PCC 16.40.970. 

III. Definitions

Certain terms used in this rule are defined by PCC Chapter 16.40. 

IV. Applicability

All PFHT Companies are subject to the requirements in this Administrative Rule.

V. Administrative Suspension Exemptions

The following Motor Vehicle License (MVL) suspension types are exempted. They will not be considered disqualifying conditions when evaluating an applicant’s eligibility for a Driver Permit approval. 

  • An MVL suspension due to non-payment of child support;
  • An MVL suspension due to failure to file a required motor vehicle crash, incident, or accident report; and
  • An MVL suspension occurs no more than three times due to failure to submit required certificates, such as an SR-22, proof of motor vehicle liability insurance coverage.
