TRN-14.35 - Digital Records Requirements

I. PURPOSE 

This rule further defines the requirements in Portland City Code (PCC) 16.40.140 K. Digital Records Requirements.

II. REGULATORY AUTHORITY

The authority to adopt this Administrative Rule is provided by PCC 16.40.970.  

III. REQUIREMENTS 

All digital records required to be maintained by a taxi company must be stored in a secure manner. Secure manner is defined as a process, equipment or method used to store digital records in safe secure location, away from the camera or any of its visible components and inaccessible by unauthorized users.  

Requirements include but are not limited to: 

  • Motion or door triggered recording 
  • Minimum of three minutes recorded post-trigger
  • Rear-facing camera inside the vehicle installed near the rear-view mirror 
  • Infrared
  • Minimum of 10 days worth of memory card storage  
  • “Memory full” indicator (if available)  
  • “Proper function” indicator 
  • Minimum field of view should be 140 degrees (width) and 80 degrees (height) 
  • Date and timestamp in the footage data 
  • Function within the temperature range of -4’F to 140’F 

Other requirements may be recommended by the PFHT Advisory Committee or added by PBOT.

A security camera that stores the digital record at a location inside the vehicle where it can be easily accessed by unauthorized users, would not meet the requirements of this section.

IV. APPROVED CAMERA MODELS

The camera models listed below have been reviewed by the Bureau and meet the digital records requirement. Any camera that meets the requirements listed above may be added to this Rule when recommended by the PFHT Advisory Committee and approved by PBOT.

V. COMPLIANCE

All taxi companies must use one of the camera models listed herein, meet the requirements of this Administrative Rule, and all relevant and related sections of Chapter 16.40.  

Failure to comply with these provisions is subject to a Class B violation and subject to penalties provided in Sections 16.40.930 through 16.40.950.
