PURPOSE

Section 1. The Council finds:

1. Title VI of the 1964 Civil Rights Act provides that no person in the United States shall, on the ground of race, color, national origin, limited English proficiency, sex, income, age or disability be excluded from participation in, be denied the benefits of or otherwise be subjected to discrimination under any program or activity receiving federal financial assistance.

2. The City of Portland, Bureau of Transportation (PBOT) assures that no person shall, on the grounds of race, color, national origin, limited English proficiency, sex, income, age or disability, be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any of its programs or activities, whether they are federally funded or not.

3. The City of Portland has adopted by Code: Title 23.01 Civil Rights by ordinance number 164709 on October 3, 1991, but has not adopted a Title VI Civil Rights Program citywide.

4. The Bureau of Transportation routinely receives federal financial assistance and must have a formally adopted Title VI Civil Rights Program.

5. The Bureau of Transportation in consultation and collaboration with stakeholders has developed a Title VI Civil Rights Program specifically for the bureau as an interim step to the development and implementation of a citywide Title VI Civil Rights Program.

6. The Bureau of Transportation seeks to utilize federal assistance for American Reinvestment and Recovery Act (ARRA) funds to keep Portlanders working and is required to have Title VI Civil Rights Program.


POLICY

NOW THEREFORE, the Council directs:

a. That the City Council hereby adopts the Bureau of Transportation Title VI Civil Rights Program as an interim step to the implementation of a citywide Title VI Civil Rights Program, substantially in accordance with Exhibit A attached to the original of this Ordinance and, by reference, made a part hereof.

b. That City Council directs the Bureau of Transportation to implement the bureau’s Title VI Civil Rights Program and authorizes the Mayor to execute Attachment E as a part of Exhibit A, Non Discrimination Policy Statement and Non-Discrimination Agreement, upon passage of this ordinance.

c. That City Council directs the Office of Management and Finance to complete a Title VI Civil Rights Program citywide.

d. This ordinance is binding City policy.

Section 2. The Council declares that an emergency exists because the Bureau of Transportation continues to accept and utilize federal assistance and seeks to confirm compliance with Title VI of the 1964 Civil Rights Act; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.
