The complainant shall be advised by the Independent Police Review (IPR) of a specific deadline to file an appeal that will be no less than 35 calendar days from the date that the Internal Affairs (IA) disposition letter is forwarded to the complainant.

No appeal received after the specified deadline given to the complainant or member in the notification from IPR or IA regarding disposition of a complaint will be permitted, except that:

If an appeal request has been received within 60 calendar days after the complainant has been notified regarding the disposition of a complaint, the IPR Director may refer the appeal to the Citizen Review Committee (CRC) for an appeal hearing and recommendation if, after conferring with the CRC Chair (or designee) and Vice-Chair (or designee):

1.  The IPR Director concludes that the appeal has merit, or

2.  The IPR Director concludes that the complainant has a reasonable explanation for failing to file the appeal in a timely manner.

If an appeal is declined as being untimely, the CRC Chair (or designee) and Vice-Chair (or designee) will review the appeal to identify any issues relating to policy, training, or quality of investigation.
