LABOR AGREEMENT - AFSCME LOCAL 189 AND BUREAU OF DEVELOPMENT SERVICES - HOUSING INSPECTOR AND SENIOR HOUSING INSPECTOR RETROACTIVE WAGES INCREASES - LETTER OF AGREEMENT

PURPOSE

Section 1. The Council finds:

1.  The City and the District Council of Trade Unions (DCTU), of which the American Federation of State, County and Municipal Employees, Local 189 (AFSCME, Local 189) is a signatory member, are parties to a collective bargaining agreement in effect for the period of July 1, 2013 through June 30, 2017 (the CBA).

2.  AFSCME, Local 189 is the sole and exclusive bargaining agent for the purpose of establishing wages, hours and conditions of employment for employees in the classification of Housing Inspector (Job ID 30000171) and Housing Inspector, Senior (Job ID 30000172).

3.  Effective July 1, 2004, employees who worked at the Bureau of Development Services (BDS) Inspector classifications received a six percent across-the-board wage increase and employees in BDS Senior Inspector classifications received a 6-1/2 percent across-the-board wage increase.

4.  Employees who worked at the Office of Neighborhood Involvement (ONI) in the Housing Inspector and Senior Housing Inspector classifications did not receive the 6-1/2 percent across-the-board wage increase that employees who worked at BDS in those same classifications received, effective July 1, 2004.

5.  Sometime after the July 1, 2004 6-1/2 percent across-the-board wage increases received by employees who worked at BDS, the employees appointed in Housing Inspector and Senior Housing Inspector classifications at ONI were transferred back to BDS. However, the employees who transferred from ONI did not receive the six percent and 6-1/2 percent wage increase that employees at BDS had received effective July 1, 2004.

6.  During DCTU 2013 successor negotiations, the City agreed to pay wage increases of six percent to employees appointed to the Housing Inspector classification and wage increases of 6-1/2 percent to employees appointed in the Senior Housing Inspector classification, effective upon ratification by both parties, April 30, 2014.

7.  On February 5, 2015, the City on behalf of BDS and AFSCME, Local 189 entered into a Letter of Agreement (LOA), Exhibit A attached hereto, that addresses the historical salary anomaly of employees who originally worked at ONI in the Housing Inspector and Senior Housing Inspector classifications and who did not receive the 6-1/2 wage increase effective July 1, 2004.

8.  The LOA provides that employees appointed to the Housing Inspector classification during the period of May 12, 2012 through April 30, 2014 who are active employees as of the date of ratification of the LOA by City Council shall receive a six percent retroactive wage increase for the period of May 12, 2012 through April 30, 2014.

9.  The LOA further provides that employees appointed to the Senior Housing Inspector classification for the period of May 12, 2012 through April 30, 2014 who are active employees as of the date of ratification of the LOA by City Council shall receive a 6-1/2 percent retroactive wage increase for the period of May 12, 2012 through April 30, 2014.


POLICY

NOW, THEREFORE, the Council directs:

a.  The LOA between the City on behalf of BDS and AFSCME, Local 189 attached hereto as Exhibit A is ratified by this Council.

b.  This ordinance is binding City policy.

Section 2. The Council declares that an emergency exists in order to avoid an unnecessary delay in the orderly implementation of the LOA; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
