"Top Ten" Regulatory Code Improvement List and Code Maintenance List (FY 2002-03)
Binding City Policy

BCP-ENB-2.02

WHEREAS, on August 14, 2002, the City Council approved Resolution 36092 as amended, implementing portions of the FY 2002-2003 Initial Regulatory Improvement Workplan; and

WHEREAS, City bureaus have been directed to present for City Council consideration each fiscal year a Regulatory Improvement Workplan to improve City regulations, regulatory procedures and related customer services. Each annual Workplan shall include a detailed Regulatory Code Improvement List (ReCIL) for amending existing regulations and adopting new regulations; and

WHEREAS, the annual Regulatory Code Improvement List (ReCIL) shall consist of three parts: future regulatory projects in the “pipeline;” a substantive policy list of “Top Ten” land use or building code regulations for improvement; and a Code Maintenance list of technical or administrative improvements; and

WHEREAS, the Office of the Mayor has conducted a series of external and internal stakeholder focus groups seeking input on staff recommended items for the “Top Ten” Regulatory Code Improvement and Code Maintenance Lists, and

WHEREAS, the “Top Ten” and Code Maintenance lists presented October 16, 2002 for City Council consideration reflect input received from a diverse cross-section of more than 120 stakeholders; and

WHEREAS, each of these items has been determined by the Council to be a high priority for inclusion in a legislative package (or packages) to be considered by the City Council and appropriate review bodies, and

WHEREAS, the City Council is committing to make final decisions on all of these items after they have gone through the appropriate legislative and/or administrative processes; and;

WHEREAS, the City Council initiates projects to move these items forward through the appropriate legislative and/or administrative processes.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portland that the following actions occur:

A. The Bureau of Planning and Bureau of Development Services are directed to bring proposals on all Title 33 items in the “Top Ten” Regulatory Code Improvement List to the Planning Commission for consideration;

B. The Bureau of Development Services is directed to bring proposals for all items on the Code Maintenance list to the Planning Commission for consideration;

C. The Planning Commission is directed to submit a report to the City Council on all items on the “Top Ten” Regulatory Code Improvement List and Code Maintenance list that would require changes to Title 33 with their recommendations, including if there are any recommendations not to act on an item;

D. The Bureau of Development Services (BDS), Environmental Services (BES) and Portland Department of Transportation (PDOT) are directed to pursue the regulatory changes on the “Top Ten” Regulatory Code Improvement List that amend Titles other than Title 33 through their respective administrative processes, and report back to the City Council;

E. The responsible Bureaus and Planning Commission are directed to report back to the City Council according to the timeline described in Exhibit C*.

F. This resolution constitutes binding city policy and shall be filed as such in the Portland Policy Documents Repository.
