PROCESS FOR FILLING VACANCIES ON THE 2011 CHARTER COMMISSION

PURPOSE

Section 1. The Council finds:

1.  The voters adopted Measure 26-98 on May 15, 2007, which became effective on January 1, 2009. Measure 26-98 added new Charter sections 13-301 through 13-303 providing for a Charter review commission.

2.  Charter Section 13-301 specifies a process for the initial appointment of Charter review commission members, but does not address whether or how vacancies on the commission should be filled.

3.  Because the 2011 Charter Commission has a large number of vacancies and has not yet completed the work that the City Council requested the commission to complete through Resolution No. 36836, the Council would like to establish a process to fill the vacancies on the commission.


POLICY 

NOW, THEREFORE, the Council directs:

a.  A vacancy exists on the 2011 Charter Commission when a member of the commission submits a letter of resignation to the appointing Council member or is otherwise not able or willing to serve.

b.  The Council may, in its discretion, appoint new members to fill any vacancies on the 2011 Charter Commission by report. The Council may establish the length of the term during which a newly appointed member may serve.

c.  The same Council member who nominated the vacating commission member may nominate the new member, subject to Council confirmation.

d.  Appointments to the commission will be made, to the extent practicable, so that the commission is reflective of the City in terms of its racial and ethnic diversity, age and geography.

e.  This ordinance establishes Binding City Policy.

Section 2. The Council declares that an emergency exists because vacancies on the 2011 Charter Commission may result in lack of a quorum for the commission, affecting its ability to complete the work requested by the Council; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
