What Does the Good Samaritan Overdose Law Cover?

If you find yourself in a situation where someone is overdosing, Oregon's Good Samaritan Overdose Law provides crucial legal protections for both you and the person in need.

​ Here’s what the law ensures:

  1. Possessing Drugs or Drug Paraphernalia: You cannot be arrested or prosecuted for having drugs or drug-related items.
  2. Being in a Place Where Drugs Are Used: You are protected even if you are in a location known for drug use.
  3. Violating Probation or Parole: If the violation is related to drug possession or being in a place where drugs are used, you are safe from legal action.
  4. Outstanding Warrants: Any warrants related to drug possession or being in a place where drugs are used will not lead to your arrest.

What the Law Does Not Cover

While the Good Samaritan Overdose Law offers significant protections, it’s important to understand its limitations. The law does not protect you from:

  1. Other Crimes: This includes drug dealing, weapons possession, DUI, and other offenses not listed in the law.
  2. Federal Warrants: Outstanding federal warrants or warrants from other states are not covered.
