These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Portland and Home Forward.
REQUEST FOR RELEASE OF FUNDS
On or about Wednesday, May 28, the City of Portland Housing Bureau will authorize Home Forward to submit a request to the U.S. Department of Housing and Urban Development (HUD)/Portland, Oregon for the release of 26 Housing Choice vouchers, authorized under Section 8(o) of the U.S. Housing Act of 1937, Omnibus Appropriations Act of 2009, Consolidated Appropriations Act of 2016, and Public Law 114-113; and HOME funding, authorized by Title II of the Cranston-Gonzalez National Affordable Housing Act of (year) and the Consolidated and Further Continuing Appropriations Acts of 2013 and 2012; to undertake a project known as Villa de Clara Vista for the purpose of redevelopment of affordable housing at 5300 NE Cully Blvd, Portland, OR 97218.
THE PROJECT
The property is located in Portland, Oregon at 5300 NE Cully Blvd, Portland Oregon 97218, and will include an adjacent parcel that has already been acquired by the owner with a current address of 6911 NE Emerson Street, Portland Oregon 97218.The existing Villa de Clara Vista apartments are located on 3 parcels at 5300 NE Cully Blvd. The properties, owned by Hacienda entity Vila de Clara Vista LP, are regulated by PHB and OHCS. Hacienda CDC owns an unregulated 4th parcel abutting the east property at 6911 NE Emerson St, which includes a single-family home. All 4 parcels are included in this development plan.
The existing 13 buildings are to be demolished and replaced with the new construction of 3 new four-story buildings with 108 multifamily housing units on approximately 1.1 acres in Northeast Portland, Oregon. New Construction will include earthwork, utilities, 36 surface parking spaces and landscaping. The project is an affordable multifamily housing project with a unit mix of 40 one-bedrooms, 57 two-bedrooms, 8 three-bedrooms, and 3 four-bedroom units. This project will replace 108 units of existing affordable housing with construction of 108 energy efficient, healthy and accessible apartments in new buildings. The existing buildings, built in the 1960s have outdated systems and deteriorating building envelops and do not meet ADA. An 8-unit building was lost to a fire, and the buildings need $8.8M in significant repairs. The project will include common areas, outdoor spaces and other amenities. The development will implement statewide housing plan policy priorities of affordable rental housing & furthering equity and racial justice.The Project will require in place households to vacate their current units and relocate to a new unit in the new development project. None of the existing tenants will be displaced during construction as the project will be phased such that the new building will be built before the existing multifamily building is demolished. The tenants will have the option to relocate to a new unit in the new development if they choose. Existing tenants include 108 families, of which 98.5% identify as people of color. Due to the use of federal funds, the Project will trigger requirements of the Uniform Relocation Act (URA). All relocation activities, including relocation planning, must be carried out in accordance with URA. Eighty-two units are for residents at 60% of area median income or below. Twenty-six units are reserved for residents at 30% of area median income. All current tenants will be eligible for a new unit with the same bedroom size as they currently live. For 26 families with vouchers, those vouchers will transfer to the new units.The first stage will involve the demolition of a vacant single-family home on the parcel located at 6911 NE Emerson, and the construction of 42 new units on that site in the 4 story Building A with a gross floor area of 32,784 square feet. Tenants currently residing in the buildings nearest the newly constructed 42 units will be relocated to the new Building A, at which point the vacated units will be demolished. On that vacated land will be built 66 new units in two new buildings, Buildings B and C. Tenants currently residing in the buildings nearest the newly constructed 66 units in Buildings B and C will be relocated to those buildings. Building B will be four stories with 26 total units and 19,002 gross square feet. Building C will be four stories with 40 units and 30,904 square feet. The remaining buildings will then be demolished. Initial construction is scheduled to begin in May 2025 and require approximately 36 months to complete all stages. The project will receive assistance through the Low-Income Housing Tax Credit Program (LIHTC) and all units will be below 60% AMI. There is a mix of units with rents at 30%, 50% and 60% AMI in addition to the 26 PBVs.The regional housing agency Home Forward has renewed 26 project-based vouchers, which were set to expire in 2024.
FINDING OF NO SIGNIFICANT IMPACT
The City of Portland has determined that the project will have no significant impact on the human environment.Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Portland Housing Bureau and online at HUD’s public comment site. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the HUD Certifying Officer, Anna Shook, at anna.shook@portlandoregon.gov, who is responsible for receiving and responding to comments.All comments received by Tuesday, May 27, 2025 will be considered by the City of Portland prior to authorizing submission of a request for release of funds.Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Portland certifies to HUD/Portland that Anna Shook in her capacity as HUD Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.HUD Portland’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Home Forward to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/Portland will accept objections to its release of fund and the RE’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:
(a) the certification was not executed by the Certifying Officer of the City of Portland;
(b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;
(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or
(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the U.S. Department of Housing & Urban Development. Potential objectors should contact the U.S. Department of Housing & Urban Development at Portland_RROF@hud.gov to verify the actual last day of the objection period.
This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
