Professional Standards Office – Complaints – Subpoenas

The Professional Standards Office works to ensure professionalism and accountability within PF&R by conducting investigations into allegations of employee misconduct, reviews and updates policies, tracks performance and behavior trends, and recommends changes to management for bureau-wide improvements. The Professional Standards Office's core values are: Clear Expectations, Resources for Success, Transparency, Results-Driven Outcomes, and Fostering Trust.

The Professional Standards Office was created in 2022 in response to the City Auditor's report on accountability. Improvements the Office has accomplished include decreased investigation timelines, creation of an online portal for commendations and complaints, revisions to key accountability policies, and the creation of standardized practices for investigations.

Subpoenas for Appearances and Subpoenas Duces Tecum

You must comply with the laws that authorize the issuance of subpoenas for your criminal, civil, or administrative case, such as ORS 136.580, ORCP 55, FRCMP 17, FRCP 45.  Please review the applicable laws related to the issuance of subpoenas.

Portland Fire & Rescue, City of Portland, reserves the right to object or quash subpoenas which are technically flawed, employed for impermissible discovery purposes, and/or seeking privileged or confidential documents that cannot be released in absence of valid court review or order.  Alternatively, submitting a public records request can be a more appropriate tool to receive records.

Please make sure that your subpoena includes a valid appearance or evidentiary hearing date.

Faxed subpoenas will not be accepted.

This form may be used to submit criminal and civil subpoenas for witness attendance, when the witness is a Portland Fire & Rescue employee acting in their capacity as a City employee, and criminal and civil subpoenas for documents (subpoena duces tecum). 

Portland Fire & Rescue requires, at minimum, fourteen (14) business days upon receipt of the subpoena before providing a response. Please review the applicable laws related to the issuance of a subpoena. 

Requesters must pay the reasonable costs for searches and production of records. Include payment for records and appearance fees in the form of a check made payable to City of Portland. If you are using the online form to submit your subpoena, please mail your payment for fees to the address noted above.
