Amend Contract with Stantec Consulting Services, Inc. to extend on-site design and construction support services for the Bull Run Filtration Project (amend Contract 30007028)

The Portland Water Bureau will extend a professional, technical, and expert services contract with Stantec Consulting Services, Inc., Contract No. 30007028 for five additional years. On November 1, 2019, Portland City Council passed Ordinance No. 189778 authorizing the Portland Water Bureau to enter into the Contract and extend the Contract for an additional five years, if necessary, by delivering a Report to Council.  

On November 1, 2019, the City of Portland entered into Contract No. 30007028 with Stantec Consulting Services, Inc., for On-Site Design Services for the Bull Run Filtration Project (Filtration). The goal of the Contract is to provide on-site design services, geotechnical site investigation, design quality management, assistance during construction, Construction Manager/General Contractor (CM/GC) support and interactions, assistance during commissioning and operations support, and other related services for Filtration. This Contract will expire on October 31, 2024. An amendment for a five-year extension is needed to provide on-site design and construction support services for the duration of Filtration (Exhibit A).

The original Contract amount was $51,000,000; Amendments 1 and 2 added $4,336,114 to the Contract. This Amendment 3 to the Contract is a no cost amendment to extend the contract for an additional five years. The contract amount remains unchanged at $55,336,114. Council action would simply extend the contract duration. Stantec Consulting Services, Inc., agreed to a minimum of 20 percent of total subcontract dollars being awarded to disadvantaged, minority, women, and emerging small businesses (COBID-certified firms). The current COBID participation total is 22.42 percent.

TO THE COUNCIL:

The Mayor concurs with the above Report to Council.

RECOMMENDS

That the Council accepts the extension of Stantec Consulting Services, Inc., Contract No. 30007028 for a duration of five years to October 31, 2029.

Impact Statement

Purpose of Proposed Legislation and Background Information

The purpose of this legislation is to allow City Council the opportunity to review and accept the recommendation to extend Contract No. 30007028 with Stantec Consulting Services, Inc.

The Portland Water Bureau is responsible for delivering the Bull Run Filtration Projects (Filtration), which will bring the City of Portland into compliance with the Long Term 2 Enhanced Surface Water Treatment Rule, a federal safe drinking water regulation. The Portland Water Bureau has a compliance agreement with the Oregon Health Authority that establishes September 30, 2027, as the compliance deadline for Filtration.  

On November 1, 2019, the City of Portland entered into Contract No. 30007028 with Stantec Consulting Services, Inc., for on-site design services for the Bull Run Filtration Project.


The goal of the Contract is to provide on-site design services, geotechnical site investigation, design quality management, assistance during construction, Construction Manager/General Contractor (CM/GC) support and interactions, assistance during commissioning and operations support, and other related services for Filtration. The Contract is scheduled to expire October 31, 2024.
The original Contract amount was $51,000,000. There have been two previous amendments to the Contract:
•    Amendment 1, dated November 1, 2022, reallocated existing contract funds from previously approved Management Reserve, reallocated the budget within existing tasks and subtasks, updated consultant billing rates, and removed a subconsultant.
•    Amendment 2, dated December 1, 2023, transferred funds from Management Reserve to existing tasks, closed out completed tasks, and increased the Contract not-to-exceed amount to $55,336,114.

The Contract will expire on October 31, 2024. An amendment is necessary to provide on-site design and construction support services for the duration of Filtration. Amendment 3 is a no cost amendment to extend the contract for an additional five years. The contract amount remains unchanged at $55,336,114.

Financial and Budgetary Impacts

The extension of this Contract has no long-term financial impacts for the City.

Funding for the Contract is available in the FY 2024–25 Budget and will be requested in the FY 2025–¬26 through FY 2027–28 Budgets.

Economic and Real Estate Development Impacts

Since 2017, the Portland Water Bureau has worked to keep the community informed and involved using multiple communication tools, including monthly e-newsletters, sharing project information in bill inserts and the annual Water Quality Report, community meetings, engagement with interested parties, and sharing project videos through the Portland Water Bureau’s social media platforms. The extension of Stantec’s design contract for the on-site design services for the Bull Run Filtration Project (Project) will not have any anticipated adverse impacts to local business, real estate, housing, cost of goods, or employment markets. The contract has created positive business impacts through the hiring of multiple COBID-certified firms. The Contract currently exceeds the City’s contract equity goal of awarding 20% of contracts to COBID-certified firms with approximately 22.42% of the Contract amount awarded to COBID-certified firms thus far.

Community Impacts and Community Involvement

There are no new impacts on the community. 

Since 2017, the Portland Water Bureau has worked to keep the community informed and involved using multiple communication tools, including monthly e-newsletters, sharing project information in bill inserts and the annual Water Quality Report, community meetings, engagement with interested parties, and sharing project videos through the Portland Water Bureau’s social media platforms.

Portland Water Bureau is considering the full spectrum of impacts to neighbors, indigenous peoples, underrepresented communities, low-income customers, and ratepayers. 

100% Renewable Goal

Accepting the recommendation for contract extension does not increase or decrease the City’s total energy use, nor does it increase or decrease the City’s renewable energy use. 

Financial and Budget Analysis

This ordinance extends the contract length with Stantec for an additional five years - as is, it is set to expire Octover 31, 2024. This does not amend the total contract.
