SUBJECT: Establishment of a Permanent Outdoor Dining Program
The presentation of a summary report on the establishment of a permanent Outdoor Dining Program is scheduled for August 23, 2023, at 9:45 a.m.
The purpose of this report is to provide Council members with an overview of a proposed Outdoor Dining Program and Design Guidelines that will allow the continued installation and operations of Sidewalk Café Seating and in-street dining installation, i.e. Street Seats. Permits under the proposed permanent program would begin in January 2024.
Presenters will include Sarah Figliozzi, PBOT Supervising Planner of the Public Realm and Street Activation Section and David McEldowney, Division Manager Right of Way Management and Permitting.
We appreciate the opportunity to share with you the proposed Outdoor Dining Program structure and Design Guidelines, along with a discussion of a proposed fee structure and financial support tools, which will return to City Council via ordinance for vote later in September.

Impact Statement
Purpose of Proposed Legislation and Background Information
The purpose of this report is to provide Council members with an overview of the proposed permanent Outdoor Dining Program (formerly Healthy Business Permits). The Outdoor Dining Program will provide rules for the use of sidewalk and curb zone for outdoor seating. The report and accompanying guidelines provide information on the following:
- Proposed design guidelines to guide the construction of future installations and modification of existing installations.
- Operations and maintenance requirements for permit holders.
- Summary of public and business engagement.
- General education and enforcement strategies to bring existing permit holders into compliance.
Financial and Budgetary Impacts
- The design guideline report does not create a financial impact. Proposed fees and financial support packages will come before City Council as an ordinance in September.
Community Impacts and Community Involvement
- This program will support business and community activity along Portland’s commercial corridors as it relates to restaurant outdoor seating.
- The community has been engaged from January through May 2023 via a series of community surveys, business interviews, communications to past and current permit holders, meetings with restaurant leaders, webinars, and presentations to business organizations.
100% Renewable Goal
- This program does not impact City’s energy consumption choices.
