Accept bid of Interlaken, Inc. for the 162nd Access to Transit - Powell to Stark Project for $2,819,949 (Procurement Report - ITB No. 00001784)

TO THE COUNCIL: 

On February 24, 2021, Council approved Ordinance Number 190304 for Procurement Services to competitively solicit the 162nd Access to Transit – Powell to Stark Project in accordance with PCC 5.34.  The Chief Procurement Officer has advertised and received bids for Bid Number 00001784 on behalf the Portland Bureau of Transportation (PBOT), with a project construction estimate of $3,480,000.  PBOT rated the project estimate confidence level as High.                                                      

Bids were opened on March 15, 2022, and two (2) bids were received.  The lowest responsive bid is from Interlaken, Inc., thus it is recommended that their bid be accepted at the estimated unit prices quoted for a total bid amount of $2,819,949 which is 19% under the engineer’s estimate.

This project is partially funded by a Federal Transit Administration (FTA) capital improvements grant administered by TriMet.  On July 31, 2019, Council passed Ordinance Number 189619 to accept FTA grant funding from TriMet and authorized an Intergovernmental Agreement with TriMet to support the work of this project.    As such, TriMet shares responsibility for administration of and compliance with FTA grant requirements.

In accordance with FTA grant requirements, TriMet’s Disadvantaged Business Enterprise (DBE) Program applies to this project and the DBE goal is 10.03%.  TriMet deemed Interlaken, Inc. to be responsive to the DBE requirement.  State based certifications other than DBE are not reported in federal aid projects.  The DBE participation for this project is 20.06%.

Interlaken, Inc. is located in Fairview, Oregon, and is a State COBID Certified WBE Contractor and is a Caucasian/female owned firm.   They have a current City of Portland Business Tax Registration and are in full compliance with all of the City’s contracting requirements.

PBOT has funds budgeted in FY 2021 for construction, inspection, and management of the project.

It is recommended that a Performance Bond and Payment Bond each at 100% of the contract amount be furnished by the Contractor.  Further, it is also recommended that a two (2) year Maintenance/Warranty Bond for 20% of the final contract amount be furnished by the Contractor before final payment is released.

The bid sureties of the remaining bidders should be returned immediately in compliance with Section 5.34.410D of the City Code.

Procurement Services recommends that Council accept this Report and authorize the Chief Procurement Officer to execute the contract with Interlaken, Inc.

The engineer’s estimate for this project was $3,480,000 and the confidence level was High. Based on the proposal received, PBOT anticipates the construction contract cost to not exceed $2,819,949 which is 19% under the engineer’s estimate. PBOT has funds budgeted in the current year for construction, inspection, and management of the project and has also included funding in its Requested budget for next year. This project is partially funded by a Federal Transit Administration capital improvements grant administered by TriMet, as well as Fixing Our Street 2, Oregon State funds (House Bill 2017), and General Transportation Revenue.
