Accept bid of T-Edge Construction for the Farragut Parks Improvements project for $1,738,000 (Procurement Report - Bid 00002008)

TO THE COUNCIL:

On November 9, 2022, Council approved Ordinance Number 191065 for Procurement Services to competitively solicit the Farragut Parks Improvements in accordance with PCC 5.34. The Chief Procurement Officer has advertised and received bids for Bid Number 00002008 on behalf of Portland Parks and Recreation, with a project construction estimate of $2,200,000. PPR rated the project estimate confidence level as Moderate.

Bids were opened on January 31, 2023, and three (3) bids were received. The lowest responsive bid is from T-Edge Construction, Inc thus it is recommended that their bid be accepted at the estimated lump sum quoted for a total bid amount of $1,738,000, which is 21% under the engineer’s estimate.

The City’s equity in contracting aspirational goal of 20% of the hard construction costs for subcontractor and supplier utilization of firms certified by the State’s Certification Office for Business Inclusion and Diversity (COBID) applies to this project. T-Edge Construction, Inc has committed to subcontract 22.44% toCOBID Certified firms as follows:

T-Edge Construction, Inc is located in Damascus, Oregon, and is a State COBID Certified DBE, WBE ESB Contractor and is a Caucasian (White)/Female owned firm.  They have a current City of Portland Business Tax Registration and are in full compliance with all of the City’s contracting requirements.

PP&R has funds for this Project included in the 5-year Capital Budget beginning in FY 2022-23 through PP&R System Development Charges, PP&R Major Maintenance Fund, and Loo Royalty Funds.

It is recommended that a Performance Bond and Payment Bond each at 100% of the contract amount be furnished by the Contractor.  Further, it is also recommended that a two (2) year Maintenance/Warranty Bond for 20% of the final contract amount be furnished by the Contractor before final payment is released.

The bid sureties of the remaining bidders should be returned immediately in compliance with Section 5.34.410D of the City Code.

Procurement Services recommends that Council accept this Report and authorize the contract award to T-Edge Construction, Inc.

Impact Statement

Purpose of Proposed Legislation and Background Information

Authorize the Chief Procurement Officer to execute a construction contract for the Farragut Park Improvements project to T-Edge Construction, Inc.  The construction cost based on bids received is $1,738,000.

Portland Parks & Recreation (PP&R) promotes health, livability, and economic vitality through the effective management of the City's award-winning parks and recreation system.

Farragut Park is located in the Piedmont neighborhood of North Portland. The park's existing amenities include a play area, a restroom building with two restrooms, picnic tables, benches, paved pathways, a splash pad, a basketball court, a paved multi-use area, and a softball field with lighting and perimeter fencing. Farragut Park is predominantly a neighborhood park, but it draws users from outside the neighborhood during softball and youth baseball seasons. Applegate Head Start shares a southern border with the park, and the students utilize the paved multi-use area and play area.

From 2020 through 2022, PP&R identified various growth and maintenance needs at Farragut Park, including the needs for toddler play equipment, the remediation of multiple accessibility barriers identified in PP&R's Americans with Disabilities Act (ADA) Transition Plan, restroom building maintenance, and the reconstruction of a basketball court. The Farragut Park Improvements Project was created to address these needs through a variety of funding sources.

Ordinance No. 191065 was approved by City Council on November 9, 2022, authorizing the Chief Procurement Officer to issue a competitive solicitation for the Farragut Parks Improvements on behalf of PP&R.

No revenues will be impacted by this legislation. 

This legislation does not change existing City policy.

Financial and Budgetary Impacts

The engineer’s estimate for this project was $2,200,000 and the confidence level was Medium. Based on bids received, PP&R anticipates the construction contract cost to be $1,738,000, which is 21% under the engineer’s estimate.

PP&R has funds for this Project in the 5-year Capital Budget beginning in FY 2022-23 through PP&R System Development Charges, PP&R Major Maintenance Fund, and Loo Royalty Funds.

No present positions will be created, eliminated or re-classified as a result of this legislation.

Community Impacts and Community Involvement

The construction contracting community, including contractors certified with the State of Oregon as minority, women, and emerging small businesses became involved when the Chief Procurement Officer advertised and publicly noticed the project on the City’s Online Procurement System on December 6, 2022.

Potential bidders were able to review the competitive solicitation, attend a pre-bid meeting, ask questions, provide comments and submit a bid in response to the Invitation to Bid (ITB).  Bids received resulted in the award of the construction contract.  Procurement Services managed the procurement process.  No protests were received.

No known persons or groups will be testifying.

No future public involvement is anticipated or necessary for this request.

Budget Office Financial Impact Analysis

The anticipated contract cost is expected to be $1.7 million, which is approximately 21% under the engineer’s moderate confidence estimate of $2.2 million. Funding for this project is included in the five-year Capital Budget beginning in FY 2022-23, backed by PP&R System Development Charges, PP&R Major Maintenance Fund, and Loo Royalty Funds. The ongoing operations and maintenance costs for this project will be absorbed within Parks 2020 Local Option Levy in the outyears, or a Council-funded successor resource. A successor resource will need to be identified and secured once the five-year term of the levy expires.
