Accept bid of $3,446,150 from Interlaken, Inc. for the Jade and Montavilla Multimodal Improvements Project (Procurement Report – Bid 00002231)

TO THE COUNCIL:

On December 7, 2022, Council approved Ordinance Number 191090 for Procurement Services to competitively solicit the Jade and Montavilla Multimodal Improvements Project in accordance with PCC 5.34. The Chief Procurement Officer has advertised and received bids for Bid Number 00002231 on behalf of the Portland Bureau of Transportation (PBOT), with a project construction estimate of $3,470,297. PBOT rated the project estimate confidence level as Moderate.

Bids were opened on October 1, 2024, and four (4) bids were received. The lowest responsive bid is from Interlaken, Inc., thus it is recommended that their bid be accepted at the estimated quoted for a total bid amount of $3,446,150 which is 0.7% under the engineer’s estimate.

Ordinance No. 179568 authorized the PBOT to participate in the Oregon Department of Transportation's (ODOT) Local Public Agency Certification Program for the delivery of federal-aid projects. On June 29, 2011, ODOT’s Director informed the Mayor that PBOT had successfully completed the requirements to become fully certified. On February 06, 2019, Council approved Ordinance Number 189376 to execute an Intergovernmental Agreement with ODOT for the Brentwood-Darlington Bike/Pedestrian Improvements Project. This is a federal-aid transportation project under the ODOT Federal-Aid Highway Program. Under ODOT’s certification, this project will be reviewed and audited by ODOT for federal-aid project compliance.

Part of the certification is that ODOT shall administer on behalf of the City, ODOT’s Disadvantaged Business Enterprise (DBE), Equal Employment Opportunity, and On-The-Job Training (OJT) programs. As such, ODOT establishes the minimum DBE goals for each federal-aid project in compliance with 49 CFR 26.  The criteria used in assigning project goals includes project location, size, duration, dollar value and the availability of DBE firms that can perform identified subcontracting opportunities. This project has a 14% assigned DBE goal. ODOT deemed Interlaken, Inc. to be responsive to the DBE requirement. State based certifications other than DBE are not reported in Federal Aid projects.  The DBE participation for this project is 37% as follows:

Interlaken, Inc. is located in Fairview, OR, and is a State COBID Certified Contractor. They have a current City of Portland Business Tax Registration and are in full compliance with all of the City’s contracting requirements.

PBOT has funds in T00710 for construction, inspection, and management of the project. 

It is recommended that a Performance Bond and Payment Bond each at 100% of the contract amount be furnished by the Contractor. Further, it is also recommended that a  year Maintenance/Warranty Bond for 20% of the final contract amount be furnished by the Contractor before final payment is released.

The bid sureties of the remaining bidders should be returned immediately in compliance with Section 5.34.410D of the City Code.

Procurement Services recommends that Council accept this Report and authorize the Chief Procurement Officer to execute the contract with Interlaken, Inc.

Impact Statement

Purpose of Proposed Legislation and Background Information

The purpose of the project is to improve accessibility and safety for non-motorized transportation at multiple sites within the Jade District and Montavilla neighborhoods.

This project will upgrade portions of the SE Stark/Washington couplet in Montavilla with safer pedestrian crossings and protected bike lanes. Further south in the Jade-District, several substandard local streets that lead to business corridors will be modernized with sidewalks and/or paving, including SE Clinton Street, SE Tibbetts Street, and signalized pedestrian and bicycle crossing at SE Tibbetts Street and 82nd Avenue will improve safety.

No revenues will be impacted by this legislation. 

This legislation does not change existing City policy.

Financial and Budgetary Impacts

Based on the proposal received, PBOT anticipates the construction contract cost to not exceed $3,446,150.

Funds are available in PBOT T000710.

No present positions will be created, eliminated or re-classified as a result of this legislation. 

Economic and Real Estate Development Impacts

The project includes improving curb ramps to meet ADA requirements at various locations, Improved Street lighting throughout project area and Widened and Protected Bike Lanes within the Jade District and Montavilla neighborhoods.

PBOT led planning processes in the Jade and Montavilla districts in 2019 which resulted in grant application for federal funding.  Affected property owners have been notified of the project need.

Community Impacts and Community Involvement

The construction contracting community, including contractors certified with the State of Oregon as Disadvantaged, Minority, Women, and Emerging Small Businesses or Serviced Disabled Veteran Businesses became involved when the Chief Procurement Officer advertised and publicly noticed the project on the City’s Online Procurement System on August 22, 2024.

Potential bidders were able to review the competitive solicitation, ask questions, provide comments, and submit a bid in response to the Invitation to Bid (ITB).  Bids received resulted in the award of the construction contract. Procurement Services managed the procurement process. No protests were received.

No known persons or groups will be testifying.

No future public involvement is anticipated or necessary for this request.
