*Authorize three-year agreement with the Regional Arts & Culture Council to administer arts programs for the City and provide for payment
The City of Portland ordains:
Section 1. The Council finds:
- The City understands the high value in public funding support for arts and culture as central to the City’s efforts in making Portland a place of equal access for creativity, education and a sustainable and prosperous quality of life.
- The City, under Ordinance 168387, approved an intergovernmental agreement with Multnomah, Washington, Clackamas and Clark Counties and Metro designating the Regional Arts & Culture Council (RACC) as the arts and culture agency for the region.
- The City entered into subsequent agreements in 1995, 2000, 2005, 2010, 2015 and 2020 with RACC to provide oversight and review of arts and culture matters and other services for the City of Portland as outlined in agreements.
- RACC has demonstrated its expertise through these prior Agreements with the City and prior as the Metropolitan Arts Commission.
- RACC is a non-profit corporation organized for the primary purpose of the stewardship of public investment in arts and culture.
- Under Portland City Code chapter 5.73, RACC has been delegated authority on behalf of the City to provide grants to support nonprofit arts organizations and other arts programs that make arts and culture experiences available to Portland residents.
- Under Portland City Code chapter 5.73, RACC has been delegated authority on behalf of the City to coordinate between School Districts and arts organizations to ensure high quality arts education for Portland students.
- Under Portland City Code chapter 5.74, RACC has been delegated authority on behalf of the City for the acquisition, fabrication, installation, de-accessioning, management and registration of public art.
NOW, THEREFORE, the Council directs:
- The Chief Administrative Officer is hereby authorized to execute an agreement with RACC substantially in accordance with the form agreement attached as Agreement for Arts Services and Exhibit A to this Ordinance.
Section 2: The Council declares that an emergency exists because delaying payment to RACC would negatively impact artists and organizations working to support Portland’s economic recovery and emotional healing. Accordingly, the agreement’s effective date in Section (3)(A) is revised from August 23, 2021 to July 1, 2021 and this ordinance shall be in full force and effect from and after its passage by the Council.
