Emergency Ordinance

*Authorize Chief Procurement Officer to execute emergency security services contracts for SmartPark Garages in a cumulative amount not to exceed $2,700,000

The City of Portland ordains:  

Section 1. The Council finds: 

  1. The SmartPark garages managed by the Portland Bureau of Transportation (PBOT) play a vital role in revitalizing the central city.
  1. A surge in crime and public drug use in SmartPark garages threatens the safety and security of both employees and customers using the SmartPark Garages.
  1. Incidents, including vehicle break-ins, physical and verbal altercations, drug use, vandalism, and biological waste, pose significant ongoing public health and safety concerns, which constitute an emergency.
  1. These ongoing threats have adverse effects on businesses and their patrons who support them.
  1. Addressing these challenges necessitates a security presence at the Smart Park garages 24 hours each day.
  1. In accordance with 5.33.130, the Chief Procurement Officer may directly enter into emergency contracts without competition in the furtherance of addressing the challenges identified in this declaration. 
  1. In order to address these security concerns as soon as possible, PBOT needs to be empowered to waive certain City contracting requirements.
  1. The Bureau's level of confidence in the cost estimates for this project is moderate.

NOW, THEREFORE, the Council directs: 

  1. In accordance with 5.33.130, the Chief Procurement Officer is hereby authorized to execute contracts with qualified security firms to provide security services for the City’s SmartPark Garages in an amount not to exceed $2,700,000.  
  2. The Mayor and City Auditor are hereby authorized to draw and deliver checks chargeable to PBOT when the invoice is presented and approved by the proper authorities. 
  3. For the purposes of the emergency contracts authorized in section A above, the requirements outlined in Administrative Rule 1.09 (Sustainable Procurement Policy) Labor Peace requirement are waived. 

Section 2. The Council declares that an emergency exists because ongoing incidents in SmartPark Garages pose a significant threat to public health and safety; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.  

Impact Statement

Purpose of Proposed Legislation and Background Information

  • Authorize PBOT to directly enter into security contract without competition in furtherance of addressing the challenges identified in SmartPark Garages. The surge in crime and drug use directly impacts the condition of the SmartPark assets, as well as the safety and security of both employees and customers using the SmartPark Garages

Financial and Budgetary Impacts

  • Estimated total project cost is $2.7M (low to moderate confidence estimate)
     
  • The contract is for security services.  The amount was determined by the number of required personnel, the hourly rate, based on 24-hour coverage.
     
  • Currently, we have a temporary security provider in place while we negotiate the terms with the new provider that was awarded the contract thru a competitive solicitation process.  The current provider is unable to cover all shifts as requested.  We are seeking emergency procurement authorization to contract with additional providers to cover unfilled security shifts.
     
  • Additional funding in the amount of $2.7 million is requested.
     
  • We are working with Council on a General Fund package to address this emergency need. If no additional funds are awarded, PBOT would need to fund this contract within GTR or defer parking garage projects.

  • Positive Community Impact: Reducing the number of incidents like vehicle break-ins, physical and verbal altercations, drug use and paraphernalia in and around the SmartPark Garages.

Financial and Budget Analysis

This action authorizes PBOT to enter a security contract up to $2.7 million for ten additional security guards at the bureau's downtown SmartPark garages to increase safety. Per discussions with the bureau, PBOT intends to absorb this cost through a combination of General Transportation Revenues and  Parking Facilities Fund resources.
