*Amend Intergovernmental Agreement with the Oregon Department of Transportation for the Brentwood-Darlington Safe Routes to School Project (amend Ordinance 189376)
The City of Portland ordains:
Section 1. The Council finds:
- The Portland Bureau of Transportation applied to Metro as part of the 2019- 21 Regional Flexible Funds program for a federal grant in the amount of $2,200,000 for design engineering and construction of the Brentwood-Darlington Safe Routes to School Project in 2017; and
- The Oregon Department of Transportation granted the Portland Bureau of Transportation the amount of $2,200,000 through an intergovernmental agreement for the design and construction of the Brentwood-Darlington Safe Routes to School Project in 2019.
- The Oregon Department of Transportation amended the intergovernmental agreement in 2020 to reduce the Federal funding for the project to no more than $2,159,999.40.
- The Oregon Department of Transportation will now grant the Portland Bureau of Transportation for the design and construction of the Brentwood-Darlington Safe Routes to School Project an additional amount of $282,483.50 for a new total of $2,442,482.90.
- The Portland Bureau of Transportation will supplement these grant funds with $2,200,000 in American Rescue Plan (ARPA) funds and an additional $3,150,000 from the Transportation System Development Charge fund. The total project cost is $7,792,483.
- The project number is T00719. The grant number is TR000279.
NOW, THEREFORE, the Council directs:
- The Commissioner-in-Charge is hereby authorized to amend the IGA and to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for the Brentwood-Darlington Safe Routes to School Project in the increased amount of $282,483.50 or total amount of $2,442,482.90. Any additional increases to the Grant Amount must be approved by the City Council.
- The Commissioner-in-charge to execute an Amendment to the Intergovernmental Agreement in the amount of $3,000,000 in a form similar to the contract attached as Exhibit A.
Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
