Emergency Ordinance

*Accept ongoing disbursement of State of Oregon Statewide Transportation Improvement Funds for Portland Streetcar from TriMet and authorize a subrecipient agreement

The City of Portland ordains:

Section 1.  The Council finds:

  1. Section 122 of House Bill 2017 Transportation Funding Package, also known as Keep Oregon Moving, established a new dedicated source of funding for improving or expanding public transportation service in Oregon. This new funding source is called the Statewide Transportation Improvement Fund, or STIF.
     
  2. The STIF Formula Fund is intended to improve Public Transportation Services for current and potential future Oregon transit users by distributing moneys to Qualified Entities.
     
  3. The State of Oregon disburses STIF funds to TriMet which includes Portland Streetcar as a subrecipient in accordance with the STIF Plan.
     
  4. TriMet convened a HB 2017 Transit Advisory Committee, with members representing transit users, Honored Citizens, employers, low-income and minority communities as well as service providers, regional governmental jurisdictions and other interested parties.
     
  5. The committee provided input on the development of the Tri-County Public Transportation Improvement Plan (PTIP), which included recommended projects for funding. This plan was later approved by the Oregon Transportation Commission (OTC).
     
  6. The OTC determines and approves funding amounts for each two-year STIF Formula Fund Cycle.
     
  7. On October 2, 2019, Portland City Council through Ordinance #189721 approved the acceptance of the first funding cycle (July 1, 2019 through June 30, 2021) in the amount of $1,771,000.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to accept an ongoing disbursement of State of Oregon, Statewide Transportation Improvement Funds (STIF) for Portland Streetcar from TriMet.
     
  2. The Director of the Portland Bureau of Transportation is authorized to execute a Subrecipient Agreement in the amount of $1,442,000 in a form similar to the contract attached as Exhibit A for the current funding cycle (July 1, 2021 through June 30, 2023).
     
  3. The Director of the Portland Bureau of Transportation is authorizedto execute Subrecipient Agreements for future funding cycles in a form similar to the contract attached as Exhibit A.
     
  4. The Director of the Portland Bureau of Transportation is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk.

Section 2.  The Council declares that an emergency exists because a delay in executing this Subrecipient Agreement could adversely impact the disbursement of funds to the City of Portland; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

The purpose of this Ordinance is to accept ongoing disbursement of State of Oregon, Statewide Transportation Improvement Funds (STIF) for Portland Streetcar from TriMet and authorize a Subrecipient Agreement for current and future funding cycles. There would be no financial impact from this legislation. Cost for this project has been budgeted in the Bureau’s FY 2022 budget.
