Amend City Code to reflect the dissolution of the Mt. Hood Cable Regulatory Commission (amend Code Chapters 3.33 and 3.115)

The City of Portland ordains.
Section 1. The Council finds:
- The City is a member of the Mt. Hood Cable Regulatory Commission (MHCRC), which was formed under an inter-governmental agreement (IGA) with the cities of Fairview, Wood Village, Troutdale, and Gresham and County of Multnomah County in 1992.
- On October 18, 2025, the MHCRC voted to recommend dissolution of the MHCRC to the member jurisdictions, and all member jurisdictions signed a dissolution agreement to end the Commission as of June 30, 2026.
- The Bureau of Planning and Sustainability (BPS) oversees the orderly development of City-owned and City-partnered broadcast and cable communications systems.
- Portland City Code (PCC) Chapter 3.33 Subsection 030.M charges BPS with providing staff support needed by the MHCRC and Chapter 3.115 outlines the roles and responsibilities of the City and MHCRC with respect to cable communications systems serving the City.
- Because the MHCRC will be dissolved effective June 30, 2026, PCC Chapters 3.33 and 3.115 need to be amended to reflect the transfer of MHCRC's roles and responsibilities to the City and to make other changes consistent with the dissolution of the MHCRC.
NOW, THEREFORE, the Council directs:
- Amend City Code Chapter 3.115 as shown in Exhibit A.
- Amend City Code Chapter 3.33 as shown in Exhibit B.

Impact Statement
Purpose of proposed legislation and background information
This ordinance is a procedural step in dissolving the MHCRC as agreed to by the City and other MHCRC member jurisdictions in the January 2026 dissolution agreement. The changes to Chapters 3.33 and 3.115 remove any references to the MHCRC and ensure that current services provided by the Commission on behalf of the City are now performed by the City. There are no anticipated programmatic or budget impacts due to the changes in this ordinance.

Community impacts and community involvement
Portland Community Media dba Open Signal has been engaged on the aspects of this code update that impact them. The update to Chapter 3.115 will remove any references to the MHCRC, including removing a requirement that the MHCRC appoint a non-voting board member to Open Signal's board of directors. The primary purpose of the non-voting member was to act as a liaison between the MHCRC and Open Signal. Since the MHCRC is dissolving, there is no longer a need for the position.
