Annex the 5048 SW Hilltop Lane property

The City of Portland ordains.

Section 1.  The Council finds:

  1. The property owners and registered voters have initiated a proposal by a consent petition to annex to the City of Portland the property described in Exhibit A, and generally illustrated with Exhibit B. 
  2. The property owners are requesting connection to City sewer and water service to a site within the City's Urban Services Boundary. As a condition of these connections, the applicant must request annexation to the City.
  3. The Bureau of Planning and Sustainability prepared a staff report meeting the requirements of City administrative rule and Metro code on December 4, 2025, more than seven days before the first reading of this ordinance.
  4. Based on the December 4, 2025, Staff Report attached as Exhibit C, which Council adopts in whole as its own findings, this proposal for annexation meets the applicable approval criteria.
  5. By operation of Charter Section 3-109, the subject property is most contiguous to Council District 4 and becomes part of that district upon annexation.

NOW, THEREFORE, the Council directs:

A. The proposed annexation described in Exhibit A is approved.

B. The subject property will be withdrawn from Tualatin Valley Fire and Rescue District #1 JT.

C. The Bureau of Planning and Sustainability will provide the City Auditor a current list of the names and addresses of public utilities, electric cooperatives, and telecommunications carriers in the City. The City Auditor is authorized and directed to file certified copies of this Ordinance with the Boundary Change Office of Metro and entities in the list provided by the Bureau of Planning and Sustainability.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The property owner at 5048 SW Hilltop Lane has submitted a petition to annex their property into the city for the purpose of connecting to City sewer. The owner recently filed permits with Portland Permitting & Development (PP&D) the with the intent to construct a single-family residence on the site. Upon contacting the City of Portland to inquire about utility connections, the owner was informed by BPS staff that the property must be annexed into the City to receive urban services, per City of Portland Comprehensive Plan Policy 8.11. The property owner submitted a sewer connection permit application to PP&D prior to being notified of the annexation requirement. The City of Portland is allowing the building permitting process to continue concurrent with the City annexation petition. 

Upon annexation, the property will retain its R20 and the "z" natural resources overlay zones.

Financial and Budgetary Impacts

Financial implication will be minimal. No connections to City services have been made at this time. Additional permitting for utility connections will be required once annexation is complete. The annexation will be reflected on Portland tax rolls upon annexation.

Economic and Real Estate Development Impacts

There are no additional economic or real estate development impacts to the proposed annexation beyond the likely construction of a single-family residence on the annexed property. In accordance with the City of Portland legislative process for annexations, property owners within 100 feet of the subject property were notified 45 days prior to Council hearing date and given the opportunity to either comment prior to or at the hearing. 

More specifically:

  • There are no business development projects that will be affected by the single property annexations.
  • There will be no impacts on business competitiveness, job growth, affordability, costs of goods, or household income.
  • There will be no impact on real estate project development feasibility.
  • There will be no potential adverse impacts from this annexation, as the property is located with Portland's Urban Service Boundary. No issues have been raised by partner bureaus or external agencies.

Community Impacts and Community Involvement

This annexation request has followed procedural requirements for an "expedited process for minor boundary changes" (BCP-ENB-1 .02) and METRO Code Section 3.09.045. Interested service providing agencies and governmental agencies have received notice of the proposed annexation as have private property owners within 100 feet of the proposed annexation. Limited inquiry has been returned in response to public notice, and no formal objection has been received.

An Economic and Real Estate Development Impact Analysis was not submitted for this proposed action. Pursuant to City Council Resolution 37664, Prosper Portland staff has reviewed the action and agree that it does not require an Economic and Real Estate Development Impact Analysis.

Financial and budget analysis

This annexation has minimal direct fiscal impact on the City. The property is a single residential parcel requesting urban services located within the City's Urban Services Boundary. The action brings the property onto the City tax roll and will generate modest annual City property tax revenue.
