*Ratify a successor collective bargaining agreement with American Federation of State, County, Municipal Employees, Local 189, for represented employees within the Office of Independent Police Review for the terms and conditions of employment of represented employees in the Independent Police Review bargaining unit
The City of Portland ordains.
Section 1. The Council finds:
- The City and American Federation of State, County, Municipal Employees (AFSCME) Local 189 are representing the employees within the Office of Independent Police Review (IPR) are parties to a collective bargaining agreement effective July 1, 2022, to June 30, 2025 (the 2022-2025 CBA).
- AFSCME Local 189 is the sole and exclusive bargaining agent for all classifications listed in Schedule A in the 2022-2025 CBA.
- On or about March 26th, 2025, pursuant to the City's obligations under ORS 243.650 representatives of the City entered into negotiations for a successor CBA with AFSCME Local 189.
- On November 20, 2025, representatives of the City and AFSCME Local 189 signed a Tentative Agreement (Agreement), Exhibit A attached hereto and incorporated herein by this reference, that outlines the terms and conditions of employment for employees covered by the AFSCME-IPR bargaining unit for the period of July 1, 2025, to June 30, 2028 (2025-2028 CBA).
- Employees in AFSCME-IPR will receive a two point four percent (2.4%) Cost of Living Adjustment (COLA) retroactive to July 1, 2025 and cost of living increases effective July 1, 2026, and July 1, 2027, which will be tied to the CPI-W West - Size Class A with a minimum increase of one percent (1%) and a maximum increase of five percent (5%).
- To address retention within IPR and to ensure ongoing compliance with the settlement agreement between the City and the United States, the CBA provides for bargaining unit employees that are in service at the end of each year of the CBA to receive a bonus no greater than $4,500 in June 2026, and $3,500 in June 2027, and $2,500 in June 2028. Bargaining unit members will receive the full bonus if their IPR work transitions to the Office of Community-based Police Accountability (OCPA) before the end of a fiscal year.
- To further address retention concerns, the City has agreed that AFSCME-IPR represented employees are guaranteed interviews with the OCPA Director and offers of employment to successful candidates for related positions in the OCPA prior to interviewing other applicants outside of the bargaining unit. The City also guaranteed offers of substantially equivalent work outside of the OCPA for bargaining unit members who either do not apply to, or are not hired into, the OCPA. Bargaining unit members moving to either position will have no reduction in pay. Employees opting layoff will be eligible for administrative leave of 30 days prior to the effective layoff date.
- The additional, and complete terms and conditions of the Agreement shall be reduced to a successor collective bargaining agreement and shall substantially conform to Exhibit A (the 2025-2028 CBA).
NOW, THEREFORE, the Council directs:
- The Agreement between the City and AFSCME Local 189 attached hereto as Exhibit A is ratified by this Council and the 2025-2028 CBA will be in a form substantially similar to Exhibit A.
- The City Administrator, the Director of the Bureau of Human Resources, and the City Auditor, with approval as to form by the City Attorney's Office, are authorized to execute the 2025-2028 successor CBA between the City and AFSCME Local 189.
Section 2. The Council declares an emergency exists to avoid an unnecessary delay in the orderly implementation of the provisions of the successor CBA; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

Purpose of Proposed Legislation and Background Information
The purpose of this ordinance is to ratify a successor collective bargaining agreement with the American Federation of State, County, Municipal Employees, Local 189 and the City of Portland for represented employees in the Office of Independent Police Review.
Financial and Budgetary Impacts
The total new spending will not exceed $161,500. The actual cost will depend on the number of current employees who remain eligible for retention bonuses in each year of the contract.
- The total cost for FY 25-26 is up to $68,600. This includes a $4,500 retention bonuses for each current employee still employed in June 2026, as well as the associated wage-driven benefits.
- The total cost for FY 26-27 is up to $53,400. This includes a $3,500 retention bonuses for each current employee still employed in June 2027, as well as the associated wage-driven benefits.
- The total cost for FY 27-28 is up to $39,500. This includes a $2,500 retention bonuses for each current employee still employed in June 2028, as well as the associated wage-driven benefits.
