*Appropriate grant from TriMet for the 82nd Avenue Transit Project for $1,800,000
The City of Portland ordains.
Section 1. The Council finds:
- Portland Bureau of Transportation will enter into an IGA with TriMet currently estimated at $4.86M.
- The IGA will be back dated to July 23rd 2024, to allow PBOT staff to begin their work on this project.
- The project number is T01426 the grant number is TR000380.
NOW, THEREFORE, the Council directs:
The FY 2024/2025 budget is hereby amended as follows:

Section 2. The Council declares that an emergency exists because the PBOT has been accruing costs in order to meet TriMet’s project schedule and the grant needs to be accepted in order for the City to receive reimbursement from TriMet in a timely manner; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information
- The purpose of the proposed legislation is to appropriate budget for the FY 2024-2025 in the amount of $1,800,000.
- TriMet desires to obtain the City’s services to perform certain planning and engineering services in support of the 82nd Avenue Transit Project for TriMet’s Project Development Phase which encompasses Concept through 100% design phase.
- The City will provide services to TriMet regarding TriMet’s work on City facilities and any modifications that impact City facilities and an IGA agreement will lay out the terms of the collaboration.
- The City of Portland’s participation is crucial to ensure a successful project that stays accountable to the commitments TriMet has made, to participate in, review and respond on technical design and engineering issues, and to ensure the interests and values of the City of Portland are represented.
- A future IGA will facilitate reimbursement for the City’s involvement as of FTA’s authorization for TriMet to enter into Project Development on July 23, 2024.
Financial and Budgetary Impacts
- All services to be provided for the Project are to be reimbursed by TriMet via terms of a future IGA.
- TriMet has financial responsibility to design and deliver the Project.
- TriMet and the City are negotiating an IGA through which TriMet will reimburse the City for staff services. The total amount of the IGA is currently estimated at $4,861,155 for services through 100% design and through March 31, 2027. This amount includes retroactive services to July 23, 2024.
- The project cost code is T01426 and is set-up to track per phase (planning phase, design, construction). The project was not included in the fiscal year 2024-2025 budget but has been added to the CIP 2025-2026 forecast. Partner Bureau costs must be posted to Bureau specific cost object and billed via OMF City Grants Office.
- City staff services budget was determined based on the information provided by TriMet and associated requested tasks. The expense is an estimate with a high level of confidence because coordination with TriMet has been ongoing.
- There is no additional funding requested.
- The IGA will create a staff position upon authorization. The new position for a Capital Project Manager II will be funded through a combination of this new Staff Services IGA and other existing IGAs on major regional projects, with ODOT for the I-5 Rose Quarter Project and/or with WSDOT for the I-5 Bridge Replacement Program.
- The project number is T01426. The grant number will be TR000380.
Economic and Real Estate Development Impacts
- The City, Metro and TriMet have held ongoing community engagement in the time that has occurred since the ODOT to City Jurisdictional Transfer in May 2022.
- The TriMet 82nd Ave Transit Project will improve bus speed and reliability in the corridor. The project outcome should have a positive effect on the overall corridor from both an economic and development perspective.
Community Impacts and Community Involvement
- The City, Metro and TriMet have held ongoing community engagement in the time that has occurred since the ODOT to City Jurisdictional Transfer in May 2022.
- TriMet developed a Cully Terminus Focus Group to provide feedback on a potential future bus layover facility in the neighborhood.
- TriMet conducted community outreach to the broader community.
- Metro convened a Steering Committee, including neighborhood and local business representatives from the Corridor. The Steering Committee is charged with selecting the Mode (Frequent Service BUS), Route (82nd Ave right-running), Terminus (TBD),
- TriMet will implement a Community Advisory Group to inform design decisions for the 15% - 100% design process.
- TriMet will facilitate Open House events at each Design Phase (15%, 30%, 60%, 90% and 100%). The City will participate in all Community and Stakeholder events.
- The community supports the project.
