*Approve annexation to the City for property within the City’s Urban Services Boundary on SE Clatsop St (Case A-1-24)
The City of Portland ordains.
Section 1.The Council finds:
- The property owners and registered voters have initiated a proposal by a consent petition to annex to the City of Portland the property described in Exhibit A, and generally illustrated with Exhibit B.
- The property owners want to annex to Portland for City sewer service to a site within the City’s Urban Services Boundary. As a condition of that connection, the applicant must request annexation to the City.
- The property description submitted by the property owners does not meet the requirements for a recorded legal description as required by ORS 308.225. The property owners must record and submit a legal description meeting the requirements of ORS 308.225.
- The Bureau of Planning and Sustainability prepared a staff report meeting the requirements of City administrative rule and Metro code on November 27, 2024, more than seven days before the first reading of this ordinance.
- Based on the November 27, 2024, Staff Report attached as Exhibit C, which Council adopts in whole as its own findings, this proposal for annexation meets the applicable approval criteria.
NOW, THEREFORE, the Council directs:
- The proposed annexation described in Exhibit A is approved.
- The subject territory is withdrawn from the Clackamas County Service District #1
- The property owner shall record a legal description with Clackamas County meeting the requirements of ORS 308.225 and submit to the City of Portland for review within 60 days of the adoption of this ordinance. If no legal description is recorded within 60 days, BPS will file an ordinance removing the property from City of Portland boundaries.
- The Bureau of Planning and Sustainability will provide the City Auditor a current list of the names and addresses of public utilities, electric cooperatives, and telecommunications carriers in the City. The City Auditor is authorized and directed to file certified copies of this Ordinance with the Boundary Change Office of Metro and entities in the list provided by the Bureau of Planning and Sustainability.
Section 2.The Council declares that an emergency exists in order that there be no delay in extending services; therefore, this Ordinance shall be in force and effect from and after its passage by Council.
Exhibits and Attachments
An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information
The property owner at 6314 SE Clatsop St. has submitted a petition to annex their property for the purpose of connecting to City sewer. The owner recently partitioned the subject property with Clackamas County with the intent to construct a single-family residence on the site. Upon contacting the City of Portland to inquire about utility connections, the owner was informed by BPS staff that the property must be annexed into the City to receive urban services per City of Portland Comprehensive Plan Policy 8.11. The property owner submitted a building permit application to Clackamas County prior to being notified of the annexation requirement. The City of Portland is allowing the building permitting process to continue with Clackamas County concurrent with the City annexation petition.
Upon annexation, the property will be assigned R7 zoning and will be removed from the Clackamas County Service District #1.
Financial and Budgetary Impacts
Financial implication will be minimal. No connections to city services have been made at this time. Additional permitting for utility connections will be required once annexation is complete. The annexation will be reflected on Portland tax rolls upon annexation.
Economic and Real Estate Development Impacts
There are no additional economic or real estate development impacts to the proposed annexation beyond the likely construction of a single-family residence on the annexed property. In accordance with the City of Portland legislative process for annexations, property owners within 100 feet of the subject property were notified 45 days prior to Council hearing date and given the opportunity to either comment prior to or at the hearing.
More specifically:
- There are no business development projects that will be affected by the single property annexations.
- There will be no impacts on business competitiveness, job growth, affordability, costs of goods, or household income.
- There will be no impact on real estate project development feasibility.
- There will be no potential adverse impacts from this annexation, as the property is located with Portland’s Urban Service Boundary. No issues have been raised by partner bureaus or external agencies.
Community Impacts and Community Involvement
This annexation request has followed procedural requirements for an "expedited process for minor boundary changes" (BCP-ENB-1 .02) and METRO Code Section 3.09.045. Interested service providing agencies and governmental agencies have received notice of the proposed annexation as have private property owners within 100 feet of the proposed annexation. Limited inquiry has been returned in response to public notice and no formal objection.

Financial and Budget Analysis
This action approves annexation of property into the City of Portland’s urban services boundary, with impending development of a single-family residence on the annexation site. Annexation was submitted with intent for eventual City of Portland utility connections upon development completion. Figures on revenues from associated property tax and permitting revenues. as well of cost of utility connection, are not currently available. Bureau staff notes estimated costs to be minimal.
