Authorize Letter of Agreement with Professional & Technical Employees, Local 17 to establish standby rate for Engineers in the Collections Operations and Maintenance Division of the Bureau of Environmental Services and provide retroactive pay for employees
The City of Portland ordains.
Section 1. The Council finds:
- The City and the Professional and Technical Employees, Local 17 (PROTEC17) are parties to a collective bargaining agreement (CBA) effective January 1, 2022 through June 30, 2026.
- Currently the PROTEC17 represented classifications of Engineer I & II (Engineers) in the Collections Systems Operations and Maintenance Division (CSD) of the Bureau of Environmental Services (BES) provide engineering technical support to Portland Bureau of Transportation (PBOT) Maintenance Operations Environmental Services Division (ESD) outside of regular shift hours. This level of assistance is required is to ensure the protection of public health, the environment, and bureau assets, as well as meet intended level of service targets and regulatory requirements.
- The standby provisions set by this letter of agreement include:
- One (1) hour of pay at the straight time rate or, at the mutual agreement of the bureau and the employee, one (1) hour of compensatory time for each eight (8) hour shift of “standby” time.
- Effective upon City configuration, and going forward, employees assigned to standby shall be paid 0.13 hours of straight time for each hour of standby worked. An employee may choose pay or compensatory time.
- Employees who completed standby shifts and associated call backs between January 1, 2022 and the date of this Agreement shall be paid the difference between the previous pay practice and this Agreement.
NOW, THEREFORE, the Council directs:
- The Acting Director of the Bureau of Human Resources is authorized to enter into a Letter of Agreement between the City and PROTEC17 in a form substantially similar to the attached Exhibit A.

Purpose of Proposed Legislation and Background Information
The purpose of this Ordinance is to authorize a Letter of Agreement with Professional & Technical Employees, Local 17 to establish a standby rate for Engineers working in the Collections Systems Operations and Maintenance Division and provide retro pay for employees who completed standby shifts back to January 1, 2022.
Financial and Budgetary Impacts
The fiscal impact is estimated to be $7,200 for FY 21-22, $16,500 for FY 22-23, and $2,100 for FY 23-24. Amounts include the retroactive wage adjustments and the corresponding increase to wage-driven benefits. The total cost of $25,800 will be absorbed by the Bureau of Environmental Services.
