Emergency Ordinance

*Authorize contract with the lowest responsible bidder for the NE 12th Ave Over I-84 & Union Pacific Railroad Bridge Project

The City of Portland ordains.

Section 1. The Council finds:

  1. In 2015 Portland Bureau of Transportation (PBOT) applied to Oregon Department of Transportation (ODOT)  for a grant in the amount of $1,957,230.24 for the NE 12th Ave Over I-84 & Union Pacific Railroad Bridge Project; and
     
  2. ODOT awarded the City of Portland a grant for the 12th Ave Over I-84 & Union Pacific Railroad Bridge Project to Portland Bureau of Transportation in the amount of $1,957,230.24 and on May 27, 2020, Ordinance No. 189986 was approved by City Council approving this project to receive funding from ODOT.
     
  3. The Project was selected as a part of the Fix-It Statewide Bridge Program.
     
  4. The Project intends to install ornamental protective fencing for safety purposes on the existing fly-over bridge that carries NE 12th Avenue over I-84; and 
     
  5. The Project received Notice to Proceed on September 10, 2024, from ODOT and PBOT is requesting permission to move forward with bidding the Project for construction.
     
  6. PBOT has allocated funds for FY 2024-25, and proposes construction, inspection, and management of the Project in FY 2025-26.
     
  7. The Bureau's level of confidence in the cost estimate for this Project is high, the Project scope is defined, and plans and specifications are final.   

NOW, THEREFORE, the Council directs:

  1. Upon the Council's acceptance of the Chief Procurement Officer's report recommending the lowest responsible bidder, the Chief Procurement Officer is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney's office. 
  2. The Mayor and Auditor are hereby authorized to provide payment chargeable to T00871.C42 when demand is presented and approved by the proper authority.

Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the Bureau’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

  • There has been extensive community involvement in both the planning and design phase of the project

Financial and Budget Analysis

This action provides contract authorization to the lowest responsible bidder for the NE 12th Ave Over I-84 & Union Pacific Railroad Bridge Project. PBOT has funds allocated within the FY 2024-25 Adopted Budget CIP, with the projects total cost estimated at $1.2 million. No additional appropriations are required as a result of this action.
