*Authorize Letter of Agreement with Laborers' International Union of North America, Local 483 to provide deferred holidays for employees on-call
The City of Portland ordains.
Section 1. The Council finds:
- The City and the Laborers' International Union of North America, Local 483 (LiUNA 483) are parties to a collective bargaining agreement (CBA) for Portland City Laborers' (PCL) effective July 1, 2022, to June 30, 2026.
- In the CBA, the parties established that represented employees shall receive an 8-hour respite period between shifts and receive a deferred holiday when required to work during a Citywide closure.
- During the inclement weather event during January 2024, at least one employee did not receive their deferred holiday due to a shortened shift length to allow for an 8-hour respite period.
NOW, THEREFORE, the Council directs:
- The Director of the Bureau of Human Resources is authorized to enter into a Letter of Agreement between the City and LiUNA 483 in a form substantially similar to the attached Exhibit A to provide employees covered under this CBA receive a deferred holiday when called in for a partial shift allowing for their requisite 8-hour respite period.
Section 2. The Council declares that an emergency exists to avoid an unnecessary delay in the orderly implementation of the provisions of the successor CBA; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
