Emergency Ordinance

*Authorize a contract with the lowest responsible bidder for 102nd & 122nd Ave Safety Improvements and Infill Lighting Project

The City of Portland ordains:                                      

Section 1. The Council finds:

  1. SE/NE 102nd Avenue and SE/NE 122nd Avenue are High Crash Corridors that do not adequately serve all modes of transportation. 
     
  2. The Portland Bureau of Transportation (PBOT)’s 102nd & 122nd Avenue Safety Improvements and Infill Lighting Project will add two signalized pedestrian crossings on SE/NE 122nd Avenue, one near SE Clinton Street and one near NE Davis Street, The project will also address illumination deficiencies along SE/NE 102nd Avenue and SE/NE 122nd Avenue.
     
  3. Project design is at 100% and PBOT wishes to proceed with bidding the project for construction.
     
  4. The Bureau of Transportation has funds budgeted in FY 2024-25 and proposed FY 2025-26 for construction, inspection and management of the project. 
     
  5. The Bureau's level of confidence in the cost estimate for this project is moderate, the project scope is defined, and plans and specifications are at 100% complete.   

  NOW, THEREFORE, the Council directs:

  1. Upon the Council's acceptance of the Chief Procurement Officer's report recommending the lowest responsible bidder, the Chief Procurement Officer is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney's office. 
  2. The Mayor and Auditor to draw and deliver warrants chargeable to T00646; T01051 & T1119.C42 when demand is presented and approved by the proper authority.

Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the Bureau’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.          

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

  • Currently, 102nd and 122nd Ave are in the High Crash Corridor that does not adequately serve all modes of transportation. PBOT project prioritizes investments for critical safety and maintenance improvements along both roads. 
  • The Portland Bureau of Transportation (PBOT) will be doing safety improvement on 102nd and 122nd Avenue. The project will add two signalized pedestrian crossings at 122nd Avenue, one near SE Clinton and one near NE Davis. The project will also address deficiencies in illumination along both roads.
  • Project design is at 100% and PBOT will be proceeding with bidding the project for construction.

Financial and Budgetary Impacts

  • No change to Portland Bureau of Transportation (PBOT) budget is requested with this ordinance. The project is in the Adopted CIP for FY 2024-25 and Proposed CIP for FY 2025-26.
  • PBOT has committed funding for design and construction of the project with several funding sources. Fixing Our Streets (FOS), System Development Charges (SDC), and General Fund (GF), for a total of $5,866,979.00
  • Level of project estimate confidence is moderate.
  • No changes in staffing levels.

Community Impacts and Community Involvement

PBOT presented the project to neighborhood associations in the vicinity of the project as well as several communications and meetings with business owners in the area. Business owners are very supportive of the project and are looking forward to the project. 

We will continue to engage the neighborhood and businesses during the construction phase.

This action authorizes a contract for the 102nd & 122nd Ave Safety Improvements and Infill lighting project. Funds for the project are included in PBOT’s FY 2024-25 Adopted CIP, including $5,866,979 in Fixing Our Streets, SDCs, and General Fund dollars. No additional appropriations are requested as a result of this action.
