*Amend Intergovernmental Agreement with Metro for the Regional Aerial Photo Consortium to update not to exceed amount to $829,993 (amend Ordinance 191761)

The City of Portland ordains:

Section 1. The Council finds:

  1. Ordinance No. 191761 passed Council on June 12, 2024 authorized the Chief Technology Officer to amend intergovernmental agreement 30003993 with Metro for the Regional Aerial Photo Consortium, to increase its not-to-exceed amount by $200,000.00.
  2. The ordinance incorrectly stated the new total not-to-exceed amount as $760,000. The correct not-to-exceed amount is $829,992.73.
  3. It is in the interest of the City to amend Ordinance No. 191761 without delay to ensure continued participation in the Regional Aerial Photo Consortium.

NOW, THEREFORE, the Council directs:

  1. Ordinance 191761 directive A is amended as follows with new language in BOLD, removed language in strikethrough:

    The City's Chief Technology Officer is hereby authorized to execute an amendment to intergovernmental agreement 30003993 to acquire LiDAR data and aerial imagery from Metro for an additional three (3) years, and add $200,000 in ongoing payments, for a new not to exceed total of $829,992.73$760,000, and a new expiration date of September 30, 2027, provided it has been approved as to form by the City Attorney’s Office.

Section 2. The Council declares that an emergency exists in order to align the total amount with the intergovernmental agreement and continue participation in the Regional Aerial Photo Consortium; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council. 

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

  • Ordinance 191761 incorrectly stated the new not-to exceed $760,000. This action corrects it to the actual not-to-exceed amount of $829,992.73.

Financial and Budgetary Impacts

  • The misstatement of the new not-to-exceed amount does not change the financial impact stated in Ordinance 191761.  BTS has the appropriation in their FY 2024-25 budget to cover the anticipated expense associated with this action. Funding for the out years of this agreement is included in the BTS 5-year plan.

  • This action will not have a material economic or real estate development impact and there was no engagement process in its development.

Community Impacts and Community Involvement

  • This action will not have a material community impact and there was no community involvement in its development.

Financial and Budget Analysis

This actions authorizes an amendment to Ordinance 191761, passed in June, 2024. The prior ordinance adjusted an IGA with Metro that included a three-year extension through September 30, 2027, as well as an addition of $200,000 to a not-to-exceed contract (30003993). Ordinance 191761 incorrectly stated the new not-to-exceed amount on the IGA and this action corrects the value from $760,000 to $829,992.73. BTS has appropriation in its FY 2024-25 budget, in fund 706, to cover the anticipated expense associated with this action. Funding for the out years of this agreement is included in BTS's Five-year plan.
