Authorize Intergovernmental Agreement with Metro for a total amount of $1,020,601 to support programs in waste reduction, recycling, and composting

The City of Portland ordains:

Section 1. The Council finds:

  1. Metro has notified the City of Portland’s Bureau of Planning and Sustainability (BPS) that Metro will provide BPS $1,020,601.00 in FY 2024-25 to support regional efforts that promote recycling, composting, waste reduction, and implementation of the 2030 Regional Waste Plan and the Opportunity to Recycle Act. 
  2. The placeholder funding amount of $985,095 was included in BPS’s FY 2024-25 Adopted Budget.
  3. Metro funds continue to support mutual regional and citywide goals for improved efforts in waste reduction, recycling, and composting programs. 
  4. No City match is required.

NOW, THEREFORE, the Council directs:

  1. The Mayor is hereby authorized to accept on behalf of the City of Portland funding from Metro in the amount of $1,020,601.00 and to execute an intergovernmental agreement with Metro, in form substantially similar to Exhibit A.
  2. The Office of Management and Finance’s Grants Office is authorized to perform all administrative matters related to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Mayor’s behalf.
  3. The BPS Director is authorized to execute any subsequent modifications to this intergovernmental agreement, provided such modifications do not increase the City of Portland’s financial obligation or risk. Any modifications that increase the City’s financial obligation or risk must be authorized by the City Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

  • Metro has provided funding to operate the Waste Reduction Program since 1990. 
  • BPS uses the per-capita funds ($721,671 in this IGA) to support overall implementation of 2030 Regional Waste Plan activities required under the IGA, general education, state law and cooperatively implemented priorities of regional concern.
  • BPS uses the Business Food Waste Requirement funds ($298,930 in this IGA) to support outreach and technical assistance to Portland businesses to promote waste prevention and ensure compliance with the composting requirement. 
  • These programs and services are critical to meeting goals set in Portland’s 2022-25 Climate Emergency Workplan and the 2030 Regional Waste Plan.
  • There has been no previous Council action directly related to this ordinance.
  • This ordinance supports City waste policies.

Financial and Budgetary Impacts

  • No City match is required for these funds. 
  • These funds directly support limited term staff providing support and outreach to businesses in meeting the city’s food scraps collection requirements and supplement the cost of several other staff FTE implementing work identified in this agreement.
  • No positions will be created, eliminated or re-classified as a result of this legislation. 
  • The funding amount of $985,095 was included in the FY 2024-25 Adopted Budget for BPS.
  • Additional budget appropriation in funding amount of $35,506 from $985,095 (adopted budget amount) to $1,020,601.00 (actual award amount).

Community Impacts and Community Involvement

  • The public was involved in the development of Metro’s budget, Metro’s 2030 Regional Waste Plan as well as the 2022-2025 Climate Emergency Workplan. 
  • Each of the plans involved public engagement efforts such as community meetings and gathering public comment through surveys and forms.

Financial and Budget Analysis
