Emergency Ordinance

*Amend Intergovernmental Agreement with Portland State University to increase amount by $500,000 to provide research, field work, technical assistance, data collection and analysis (amend Intergovernmental Agreement 30007361)

The City of Portland ordains:

Section 1. The Council finds:

  1. The Bureau of Planning and Sustainability (BPS) mission is to take action to shape the future of Portland and advance climate protection for a more prosperous, healthy, equitable and resilient city now and for future generations.
  2. BPS has an existing Intergovernmental Agreement with PSU to provide research, field work, technical assistance, data collection and analysis.
  3. Under this agreement, PSU and BPS engage in projects according to Task Orders that specify a scope, deliverable and compensation.
  4. In order to continue and expand our work, additional funds and clarifying language are required to be added to the agreement. 
  5. The established cost is up to $1,000,000 over an eight-year period.

NOW, THEREFORE, the Council directs:

  1. The Director of the Bureau of Planning and Sustainability or their designee is hereby authorized to amend Intergovernmental Agreement No. 30007361 with Portland State University to add $500,000 for a not to exceed total amount of $1,000,000 and update the agreement language, in a form substantially similar to the agreement attached as Exhibit A.

Section 2. The Council declares that an emergency exists because a delay in approving the attached agreement would impact the City’s ability to perform the activities authorized by the IGA, including efforts to reduce industrial climate and environmental impacts; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

This action supports the ongoing collaboration between the Bureau of Planning and Sustainability and Portland State University. This is the second contract amendment. The purpose of this amendment is to add funds and update the language. The proposed legislation supports the City’s efforts to address issues related to planning, sustainability, and climate change.

BPS and PSU signed a Memorandum of Understanding in 2023 that established a two-year partnership to advance the Clean Industry Initiative. This partnership supports efforts to curb carbon emissions, reduce waste, improve air quality, and advance economic and workforce development for the industrial sector. By adding funds to the existing Intergovernmental Agreement, this ordinance will ensure that BPS and PSU are able to deliver the goals outlined in the MOU.

Financial and Budgetary Impacts

This is additional spending for an existing Intergovernmental Agreement. The increased funds will be used to expand existing work and add new task orders when appropriate. This agreement will be paid using funds in the approved BPS budget.

Community Impacts and Community Involvement

This action continues existing work with PSU, including projects that support environmental and climate justice outcomes. BPS works to align resources that achieve community goals related to planning, research, sustainability, and climate action, and this amendment will support that work.
