Emergency Ordinance

*Accept a grant in the amount of $20 million from the U.S. Department of Transportation for Safe Systems on 122nd Ave project

The City of Portland ordains:

Section 1. The Council finds:

  1. In September 2022 City Council authorized the Portland Bureau of Transportation to apply to the United States Department of Transportation for a grant in the amount of $20,000,000 for the Safe Systems on 122nd Avenue project.
     
  2. The United States Department of Transportation has notified the City of Portland that it will award a grant for the Safe Systems on 122nd Avenue project to the Portland Bureau of Transportation in the amount of $20,000,000; and
     
  3. The project will implement recommendations from the 122nd Avenue Plan completed in December 2023 (Exhibit B).
     
  4. The project number for this is T00998.  The grant number is TR000344. 
     
  5. The Portland Bureau of Transportation will provide the required 20% match for the grant in the amount of $5,005,000 using Fixing our Streets funding, which is budgeted in the Capital Improvement Program for paving and multimodal improvements on 122nd Avenue, and results in a total project cost of $25,005,000.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the United States Department of Transportation for the Safe Systems on 122nd Avenue project in the amount of $20,000,000.
  2. The Commissioner-in-Charge to execute the grant agreement in a form similar to the contract attached as Exhibit A.
  3. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty-five percent (25%) or greater.  
  4. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.                  

Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The Safe Systems on 122nd Avenue project will make comprehensive safety improvements to 122nd Avenue in East Portland between Foster Road and Sandy Boulevard. 

122nd Avenue is identified as a High Crash corridor for all travel modes, and this project aims to use data-driven measures to improve safety by facilitating safer speeds, better separating road users, providing more visibility and otherwise enhancing the corridor.

The 122nd Avenue Plan process began in 2018, and a final plan was released in late 2023.

City Council approved applying for this grant on September 7th, 2022. Since being awarded the grant in early 2023, staff have been working with USDOT and FHWA officials on developing this grant agreement. 

Financial and Budgetary Impacts

  • The total project cost is estimated to be $25,005,000.00 (low confidence estimate). The project is receiving $20,000,000.00 in Federal funds through the Safe Streets and Roads for All grant program from the 2021 Bipartisan Infrastructure Law. 
     
  • The required 20% match for the grant is utilizing $5,005,000.00 of Capital Improvement Program Fixing Our Streets funding that has been allocated for paving and multimodal enhancements on 122nd Avenue.
     
  • The capital project number is T00998. 
     
  • The grant number is TR000344.
     
  • This project and grant funding is included in PBOT’s FY24-25 budget and five-year CIP forecast. 
     
  • There is no additional funding requested.

Community Impacts and Community Involvement

  • There will be opportunities for public feedback before decisions are made about the specific street design and other project elements.
     
  • Impacts during construction are anticipated to occur in 2028-2029
