Emergency Ordinance

*Authorize contract with Comcast for fiber optic and data transmission services for five years not to exceed $4 million

The City of Portland ordains: 


Section 1. The Council finds:

  1. The Office of Management and Finance, Bureau of Technology Services (BTS) is responsible for the operation and maintenance of the City’s communications systems including the fiber optic network, which deliver internet and broadband connectivity. 
     
  2. The fiber optic network is the backbone of the City’s communication infrastructure that enables City staff to have access to email, dial tone, internet service and other City applications.
     
  3. The fiber optic network is used by every City of Portland bureau and their employees, including but not limited to Bureau of Transportation, Bureau of Environmental Services, Water Bureau, Portland Fire, Portland Police and Bureau of Emergency Communications. This network also serves other public agencies such as Multnomah County, Portland State University and Portland Public Schools.
     
  4. In order to properly maintain the City’s fiber optic network, upgrades must be performed regularly as new technology is introduced, and the systems must be expanded and scaled to meet increasing demand.
     
  5. In accordance with City Code 5.33.160, the City is seeking to establish a cooperative contract with Comcast Business Communications, LLC, utilizing the Region 14 Education Service Center’s Master Agreement for Telecommunication Services #01-98, administered by the National Cooperative Purchasing Alliance.  
     
  6. The estimated cost for the purchase of these upgraded services over a period of five years is approximately $4,000,000.
     
  7. The Bureau’s confidence level in the estimated cost is medium.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to execute a contract with Comcast Business Communications, LLC for 5 years and a not-to-exceed amount of $4,000,000 for fiber optic and data transmission services provided the contract has been approved as to form by the City Attorney’s office.

Section 2. The Council declares that an emergency exists as a delay in proceeding with executing this agreement may result in additional expenses and delay in providing a mission critical, public safety data communications systems for the City of Portland; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council. 


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
