Emergency Ordinance

*Authorize contract with CenturyLink Communications, LLC, dba Lumen, for ongoing data transport services for three years not to exceed $4 million

The City of Portland ordains: 

Section 1. The Council finds:

  1. The Office of Management and Finance, Bureau of Technology Services (BTS) is responsible for the support and upkeep of the City's communications systems. To this end, the Bureau of Technology Services provides and supports data transport services for City bureaus.
     
  2. Data and Internet services provide portions of the City's communications infrastructure that allows interconnectivity between City of Portland buildings. Data transfer supports our use of email and Microsoft Teams and other applications. This contract supports and maintains these services to which the City of Portland subscribes.
     
  3. In accordance with City Code 5.33.160, the City is seeking to establish a cooperative contract with CenturyLink Communications, LLC, dba Lumen for broadband services utilizing the State of Oregon, Department of Administrative Services’ agreement #9447 PA.
     
  4. CenturyLink Communications, LLC, dba Lumen has a current City of Portland business license tax account, is in compliance with the Equal Benefits Program, and their EEO Certification is current.  CenturyLink Communications, LLC dba Lumen is not a COBID certified firm. The Bureau's level of confidence for this contract is high, as there is very good historical information showing purchases made for these types of services for the bureau.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to execute a contract with CenturyLink Communications, LLC, dba Lumen, for 3 years and a not-to-exceed amount of $4,000,000 for ongoing data transport services provided the contract has been approved as to form by the City Attorney’s office.

Section 2. The Council declares that an emergency exists as a delay in proceeding with executing this agreement may result in additional expenses and delay in providing a mission critical data network communications systems for the City of Portland; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

The purpose of this legislation is to authorize a contract with CenturyLink Communications, LLC, dba Lumen, for a three-year term and a not to exceed amount of $4 million. This contract will allow the Bureau of Technology Services to properly maintain and support the data transport services of the communications infrastructure for the City of Portland. These services include data and Internet.

Financial and Budgetary Impacts

BTS has appropriation in their FY 2023-24 budget to cover the anticipated current year expense associated with this action. Funding for the out years of this agreement is included in the BTS five-year plan.
