*Authorize Intergovernmental Agreement with the City of Wilsonville for local improvement district services
The City of Portland ordains:
Section 1. The Council finds:
- The cities of Portland and Wilsonville collaborated on local improvement district (LID) policy when LID legislation was proposed by the Oregon Legislature in October 2013. The cities of Portland and Wilsonville were both sought out for LID policy guidance based on the volume of LIDs administered and effective management of LIDs.
- The cities of Portland and Wilsonville were joined by the City of Keizer in an LID best practices presentation to the Oregon City Attorneys’ Association in May 2015. Education and information sharing to promulgate best practices among Oregon cities was prioritized over additional LID legislation which would have been difficult to effectively implement statewide.
- While the City administers the most LIDs statewide, other cities have recently formed or completed large and significant LIDs after informal communication and information-sharing with the City.
- On January 24, 2024, the City of Wilsonville requested the assistance of the City to provide local improvement district services. The City has an interest in ensuring that the City of Wilsonville's LID is successful and is managed effectively.
- The City has an appointed Local Improvement District Administrator per Chapter 17.08 of City Code who will provide services to the City of Wilsonville in forming and completing its LID.
- The City will invoice the City of Wilsonville for the services it provides, and the City of Wilsonville will reimburse the City for the services.
- The cities of Portland and Wilsonville desire to enter into this agreement without undue delay to ensure the mutual benefit it will provide to both cities.
NOW, THEREFORE, the Council directs:
- The Director of the Portland Bureau of Transportation is authorized to enter into an agreement with the City of Wilsonville in a form substantially similar to the agreement attached as Exhibit A.
Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the Local Improvement District Administrator’s ability to perform the activities for the City of Wilsonville authorized by the Intergovernmental Agreement; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
