Authorize Intergovernmental Agreement with Multnomah County for the Hawthorne Bridge Overlay Project not to exceed $220,000

The City of Portland ordains:

Section 1. The Council finds:

  1. Multnomah County is planning major maintenance work for the Hawthorne Bridge and associated ramps via the Hawthorne Overlay Project (“Project”).
  2. The City of Portland, through the Portland Bureau of Transportation (PBOT), wishes to partner with Multnomah County on the Project.
  3. The partnership between the City and Multnomah County will allow the Project to widen a section of sidewalk and add a bus island to support safer multimodal travel on a critical link in Portland’s transportation system.
  4. City payment to Multnomah County is needed to cover construction costs for the sidewalk widening and bus island for an amount not to exceed $220,000.
  5. The Bureau’s level of confidence in the cost estimates for this project is high.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to enter into an intergovernmental agreement with Multnomah County in a form similar to the attached Exhibit A and provide payment to Multnomah County for an amount not to exceed $220,000.
  2. The Commissioner-in-Charge and/or Director of the Portland Bureau of Transportation is authorized to execute amendments to the intergovernmental agreement, approved as to form by the City Attorney, provided the changes do not increase the City’s financial risk. Increases to the payment amount must be approved by the City Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

  • Authorize PBOT to pay Multnomah County for construction of sidewalk widening and a bus island on the Hawthorne Bridge as part of a county bridge maintenance project scheduled to start construction in 2024.

Financial and Budgetary Impacts

The intergovernmental agreement calls on Multnomah County to invoice the City for up to $220,000 not later than 30 days after issuance of substantial completion for the Hawthorne Overlay Project and no later than June 30, 2025. The City has identified $220,000 in existing funds to meet the terms of the intergovernmental agreement.

  • Total project cost of the PBOT obligated amount is no greater than $220,000 (high confidence estimate), for delivery by Multnomah County as part of their Hawthorne Overlay Project.
  • There is no additional funding requested.
  • Costs for this project will be posted to PBOT Capital Project T01390.C42, which is included in PBOT’s FY 24-25 budget and five-year CIP forecast.
  • The purpose of taking this document to City Council is to authorize payment from PBOT to Multnomah County for construction of the identified project elements as part of a county maintenance project.

  • Multnomah County briefed their Bicycle and Pedestrian Community Advisory Committee on the work included in this intergovernmental agreement.
