Amend contract with Consor North America, Inc. for professional engineering services for the Marx and 105th Pump Station Upgrade Project in the amount of $458,676 (Project E11044; amend Contract 30006910)

The City of Portland ordains:

Section 1. The Council finds:

  1. Pursuant to Portland City Code Section 5.68.035, the Chief Procurement Officer authorized the Bureau of Environmental Services to enter into Contract No. 30006910 with Murraysmith, Inc. (Consultant) for the Marx & 105th Pump Station Upgrade (Project) in the amount of $775,774.
     
  2. Amendment No. 1, effective August 3, 2020, authorized additional engineering services to develop the design for a small control building, revise design for the electrical panels, and increased the Contract by $62,631.
     
  3. Amendment No. 2, effective January 1, 2021, changed the City’s Project Manager and revised the Hourly Rates.
     
  4. Amendment No. 3, effective March 1, 2022, authorized additional engineering services to incorporate additional permitting support, and increased the Contract by $71,243.
     
  5. Amendment No. 4, effective October 3, 2022, changed the Consultant’s name from Murraysmith, Inc. to Consor North America, Inc.
     
  6. Additional design engineering services are required to update and design the pump station at a new site. A fifth amendment to Contract No. 30006910 with Consor North America, Inc., is required to extend the term from March 1, 2025 to June 30, 2027 and to increase the contract not-to-exceed amount of $909,648 by $458,676 for a new total not-to-exceed amount of $1,368,324 (a 76.38% increase from the original contract amount).
     
  7. The COBID D/M/W/ESB participation on this contract is $548,934 or 40.12% of the total amended contract value.
     
  8. The established amended cost is $1,368,324. The level of confidence is high. Funds will be made available in the Sewer System Operating Fund, FY 2023-24 Budget, Bureau of Environmental Services, WBS Element E11044.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to execute an amendment to Contract No. 30006910 with Consor North America, Inc. for the purposes described in Section 1 in a form substantially in accordance with the attached Exhibit A, provided the amendment has been approved as to form by the City Attorney.
  2. The Mayor and Auditor are hereby authorized to pay for the contract from the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The purpose of the Marx & 105th Pump Station Upgrade (Project) is to replace the existing pump station to improve reliability and maintenance. The existing pump station at NE 105th has reached the end of its useful life. Operation and maintenance costs will increase as the station deteriorates and replacement pump parts become extremely difficult to find as they age. There is also an increased risk of failure, which can lead to surface overflows and regulatory violations. The existing pump station site is very small and allows for no dedicated off-street parking, which is needed to provide safe access for operation and maintenance staff.

The amendment is needed because the original scope of the contract was to rebuild and expand the existing pump station by purchasing an easement on adjacent property. However, the adjacent property owner was not interested in providing an easement due to the implications it would have for the use of their property. A property on the west side of NE 105th Ave became available for purchase in 2022. An alternatives analysis between the existing and proposed property found that the proposed property would have slightly lower construction costs, the site is larger allowing access for Operation and Maintenance as well as future expansion, the property would be owned by BES and the permitting process would likely be easier (i.e., faster) as the property is outside the environmental zone. Pursuant to Ordinance No. 191509, Bureau of Environmental Services (BES) is in the process of purchasing property at 5635 NE 105th to accommodate necessary upgrades for the Project.

A fifth amendment is required for Contract No. 30006910 as the scope of the project changed to relocate the pump station to 5635 NE 105th. The revised scope of services include:

  1. Update a portion of the Pre-Design Task 2 for the new pump station location at 5635 NE 105th Ave.
  2. Update Design Task 3 for the new pump station location at 5635 NE 105th Ave.
  3. Design sewer realignment to divert flows to new pump station location at 5635 NE 105th Ave and force main extension to connect to the existing force main at the current pump station location.

Financial and Budgetary Impacts

This legislation authorizes a contract amendment and allows payment for the project with an estimated cost of $458,676. Funds are available in the Sewer System Operating Fund, FY2023-2024 Budget, Bureau of Environmental Services, WBS Element E11044.

  • This project will neither generate nor reduce current or future revenue. 
  • No new City positions will be created.

Community Impacts and Community Involvement

The Marx & 105th Pump Station Upgrade project is in Northeast Portland and serves industrial parcels in the northwest portion of the Parkrose Neighborhood. The service area is bounded by I-205 to the west, NE 112th Ave to the east, Lower Inverness Slough to the north, and NE Killingsworth St to the south. The total service area is approximately 65 acres.

100% Renewable Goal

There is no impact anticipated towards the City’s 100% Renewable Goal.
