Authorize competitive solicitation and contract with the lowest responsive and responsible bidder and provide payment for construction of the NE 87th and Marx Sewer Reconstruction Project for an estimated cost of $1,006,000 (Project E11505)
The City of Portland ordains:
Section 1. The Council finds:
- The Bureau of Environmental Services (BES) needs to reconstruct approximately 613 feet of sewer pipe along NE 87th Ave between NE Marx Dr and NE Columbia Ct in Northeast Portland.
- BES has prepared plans and specifications for replacing the deteriorated sewer pipe and service laterals and rehabilitating maintenance holes. BES requires the furnishing of materials and labor for this project.
- The estimated cost is $1,006,000. The level of confidence for this estimate is high. Funds will be made available in the Sewer System Operating Fund, FY 2024-25 Budget, Bureau of Environmental Services, Project number E11505.
NOW, THEREFORE, the Council directs:
- The Chief Procurement Officer is authorized to conduct a competitive solicitation process for the lowest responsive and responsible bidder in accordance with Chapter 5.34 of the Portland City Code.
- Upon the Council’s acceptance of the Chief Procurement Officer’s report recommending the lowest responsive and responsible bidder, the Chief Procurement Officer is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney’s office.
- The Mayor and Auditor are hereby authorized to pay for the contract from the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

Purpose of Proposed Legislation and Background Information
The NE 87th and Marx Sewer Reconstruction project is part of BES’s Maintenance Capital Contract program. Program goals are to design and construct relatively small-scale, urgent collection system projects. Projects address structural failures, near failures, localized flooding, and hydraulic capacity problems. Projects in this program are prioritized based on the criticality and condition of the facility and the need to protect health and property.
Approximately 613 feet of failing sewer infrastructure will be replaced during this project.
Financial and Budgetary Impacts
This project is part of BES’s Maintenance Capital Construction program, which is funded through FY 2024-25. The proposed project estimate has been assigned a high confidence level.
This project will neither generate nor reduce current or future revenue. No new City positions will be created.
Community Impacts and Community Involvement
Environmental Services has completed design on a project to repair 613 feet of public sewer pipe in Northeast Portland. The project area is along NE 87th Ave between NE Marx Dr and NE Columbia Ct. The existing pipe has deteriorated due to age and root intrusion, resulting in sewage leaking in the surrounding soil.
The reconstruction project includes 433 feet of 8-inch sewer pipe and 180 feet of 6-inch sewer laterals. The project will need a Street Opening Permit, Soil Disposal Permit and Batch Discharge Permit.
The project location includes industrial businesses that will have semi-truck routes impacted.
Notification of businesses within a 2-block radius has been completed. Our public involvement staff on this project, Emily Volpert, will continue outreach throughout construction.
100% Renewable Goal
This project neither contributes nor takes away from the City’s goal of meeting 100 percent of community-wide energy needs with renewable energy by 2050.
