Emergency Ordinance

*Authorize Agreement between the City and the Oregon Museum of Science and Industry for the SE Water Ave Realignment Project not to exceed $500,000

The City of Portland ordains:

Section 1. The Council finds:

  1. In November of 2018, Portland City Council adopted the Central City in Motion plan, which included a proposed design for SE Water Avenue.
     
  2. On February 17th, 2023, Portland City Council adopted the Oregon Museum of Science and Industry’s (OMSI’s) Central City Master Plan, which includes a realignment of SE Water Avenue through the OMSI campus.
     
  3. The Parties have agreed upon the need to realign SE Water Avenue between SE Clay Street and SE Caruthers Street to improve the access and circulation for the OMSI District and the Central City, and to accommodate the future development of the OMSI campus.
     
  4. On May 9, 2023, OMSI secured funding from the State of Oregon to further the design of the realigned Water Avenue and secured the services of KPFF to foster this design.
     
  5. OMSI has agreed to reimburse PBOT for staff time spent reviewing and commenting on these designs, with a cost not to exceed $500,000.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge from the Portland Bureau of Transportation is hereby authorized to execute an Agreement with OMSI in a form similar to the attached Exhibit A.
  2. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk.  Increases to the contributory amount must be approved by the City Council. 

Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the Intergovernmental Agreement; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
