The City of Portland ordains:

Section 1. The Council finds:

  1. The City of Portland (City) owns Washington Park, which includes the Japanese Garden, the World Forestry Center, the Hoyt Arboretum, several memorials, other Washington Park attractions, and land adjacent to the Oregon Zoo, including the parking lots serving the patrons of all Washington Park venues. Washington Park receives an estimated three million visitors every year.
  2. Washington Park Transportation Management Association, doing business as Explore Washington Park (EWP), is an Oregon non-profit corporation whose purpose is to adopt and implement a Transportation Management Plan for Washington Park and manage all services and programs associated with transportation management for the park. EWP serves all of the venues within Washington Park and implements programs and activities that broadly serve all venues and visitors.
  3. EWP, through its Board of Directors, has successfully managed transportation, visitor, and parking services in Washington Park for the last ten years through City Ordinance 185779.
  4. Funding for EWP services comes from the Washington Park Trust Fund, which is derived from Washington Park parking revenues, collected by the City as part of the parkwide Pay-to-Park program.
  5. The EWP agreement expired on August 1, 2023, and Portland Parks and Recreation negotiated with EWP for its continuation of services on an interim basis until the parties can negotiate a new agreement.
  6. This new five-year Contract for Goods and Services (Agreement):
    1. Authorizes EWP to continue to provide transportation, visitor, and parking management services in Washington Park.
    2. Clarifies responsibilities for contract performance and expectations on deliverables.
    3. Modifies City funding allocations in the amount of approximately $1,700,000.00 per year, not to exceed $8,500,000.00 total.
    4. Updates other terms and conditions to perform prudent goods and services on behalf of the City.
  7. Due to its creation at the request of the City and extensive history and knowledge of Washington Park, EWP is uniquely qualified to continue managing transportation, visitor, and parking services in Washington Park.
  8. Pursuant to City Code 5.68, Professional, Technical and Expert Services Contracts, if services or expertise required for a project are only available from a sole source, or justifiably available from only one contractor, then the Chief Procurement Officer may authorize selection of a contractor without following the prescribed competitive contracting requirements. This sole source contract is being acquired as an exception to the competitive selection process identified in PCC 5.68 and the PTE Manual. A public notice was posted, and no protests were received.

NOW, THEREFORE, the Council directs:

  1. The Director of Portland Parks and Recreation, or designee, is authorized to execute a Contract for Goods and Services with Washington Park Transportation Management Association in a form substantially similar to Exhibit A, and any amendments so long as they are included in the Portland Parks and Recreation’s budget process, in substantial compliance with the intent of this Ordinance and as approved as to form by the City Attorney.

Section 2.  The Council declares that an emergency exists because a delay will cause interrupted transportation, visitor, and parking services in Washington Park, negatively affecting the tenants, businesses, and visitors of Washington Park; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of proposed legislation and background information

Washington Park Transportation Management Association, doing business as Explore Washington Park (EWP), through its Board of Directors, has successfully managed transportation, visitor, and parking services in Washington Park for the last ten years through City Ordinance 185779. EWP’s purpose is to adopt and implement a Transportation Management Plan for Washington Park and manage all services and programs associated with transportation management for the park. The agreement between the City of Portland (City) and EWP expired on August 1, 2023, and Portland Parks and Recreation negotiated with EWP for its continuation of services on an interim basis until the parties can negotiate a new agreement. The City is unable to pay EWP for services until a new agreement is entered into between the parties. The previous City funding under the agreement was on average $1,400,000.00 per year since fiscal year 2021-2022 and came from the Washington Park Trust Fund. In addition, EWP received on average approximately $75,000.00 in annual in-kind contributions, grants, and other funding.

Financial and budgetary impacts

This new five (5) year Contract for Goods and Services establishes City funding at approximately $1,700,000.00 per year for a total not to exceed $8,500.000.00. Funding will come from the Washington Park Trust Fund, which is derived from Washington Park paid parking revenues. EWP will continue to retain annual revenues from in-kind contributions, grants, and other sources of funding.

Community impacts and community involvement

This Contract for Goods and Services will allow EWP to operate without interruption and negative impacts to the community and visitors. Annually, EWP provides over 75,000 free shuttle rides to visitors within Washington Park and free overflow parking shuttle services to 56,000 visitors who park in overflow parking on busy days. Without this service, those visitors will need to find an alternative way to visit the park leading to higher demand for the limited parking in the park, higher car congestion on park roads, significant difficulty accessing the venues at the park, a lower number of visitors due to the restricted parking and access issues, and lower overall visitor satisfaction. The greatest impact will be on the International Rose Garden and Portland Japanese Garden as TriMet only runs hourly service to that section of the park.

100% renewable goal

Part of EWP’s purpose through active access management and programs is to increase the use of shuttle service and non-auto transportation alternatives such as bike and pedestrian programs, use of TriMet, and carpooling to the park.
