The City of Portland ordains:

Section 1. The Council finds:

  1. The City’s current rules listed above impact the City through need for evaluating  current practices for conflicts with Oregon state and federal laws for updated leave allowances. 
     
  2. The proposed rule revisions were updated to incorporate feedback from bargaining units, employee and stakeholders from bureaus and offices across the city, and were redistributed for review and comment in November 2023.
     
  3. HRAR 6.01, General and Administrative Leaves of Absence, clarifies the general paid and unpaid administrative leave process for information and addresses new leave allowances for atypical and rare incidents that occur while employees are at work.
     
  4. HRAR 6.07, Military Leave, expands the language for eligibility and the leave period from 14 calendar days to 21 working days to comply with the new Oregon Military leave law, House Bill 2865 effective January 1, 2024.

NOW, THEREFORE, the Council directs:

  1. Human Resources Administrative Rule 6.01, General and Administrative Leaves of Absence is hereby amended in accordance with Exhibit A, effective immediately upon passage.
  2. Human Resources Administrative Rule 6.07, Military Leave is hereby amended in accordance with Exhibit B, effective January 1, 2024.

Section 2. The Council declares that an emergency exists to protect the rights of employees, to clarify and broaden critical leaves of absence and to avoid noncompliance with State of Oregon legislative changes which come into effect on January 1, 2024; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of proposed legislation and background information

The purpose of this emergency Ordinance is to amend Human Resource Administrative Rules (HRAR) to clarify and update leave allowances to reflect current practices and to comply with the Oregon State law changes.

HRAR 6.01 revisions clarify the general paid and unpaid administrative leave process for information and addresses new leave allowances for atypical and rare incidents that occur while employees are at work. This rule change addresses time needed to be away from work following infrequent or unpredictable occurrences. 

HRAR 6.07 revisions expand the language for eligibility of service members and the leave period from 14 calendar days to 21 working days to comply with the new Oregon Military leave law, House Bill 2865 effective January 1, 2024. This additional time accounts for the actual training time often required by the service member and employees.

Financial and budgetary impacts

There are no financial or budgetary impacts to the proposed changes. The impact would be reflected in time versus an actual hard cost. Any additional leave allowance time paid would be dependent on the number or scope of atypical or rare occurring events that occur.

Community impacts and community involvement

This is an update to City Human Resource policy which affects only City employees.
