Emergency Ordinance

*Amend Intergovernmental Agreement with the Oregon Department of Transportation for the Jade and Montavilla Multimodal Improvements Project

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Portland Bureau of Transportation applied to Metro as part of the 2019-21 Regional Flexible Funds program for a federal grant in the amount of $3,200,000 for design engineering and construction of the Jade and Montavilla Multimodal Improvements in 2017; and
     
  2. Through Ordinance 189767, the Oregon Department of Transportation granted the Portland Bureau of Transportation for the design and construction of the Jade and Montavilla Multimodal Improvements Project in the amount of $3,200,000.
     
  3. The Oregon Department of Transportation will grant the Portland Bureau of Transportation for the design and construction of the Jade and Montavilla Multimodal Improvements Project an additional amount of $3,000,000.
     
  4. The Portland Bureau of Transportation will over match the grant with an additional $2,894,000 from the Transportation System Development Charge fund. The total project cost is $9,094,000.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to amend the IGA and to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for the Jade and Montavilla Multimodal Improvements Project in the amount of $3,000,000.  Any increases to the Grant Amount must be approved by the City Council.
  2. The Commissioner-in-Charge to execute an Amendment to the Intergovernmental Agreement in the amount of $3,000,000 in a form similar to the contract attached as Exhibit A.

Section 2. The Council declares that an emergency exists to move forward with accepting the dollars to install important infrastructure improvements in the Jade District and Montavilla neighborhoods; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

  • To amend an IGA for design and construction of the Jade and Montavilla Multimodal Improvements project.

Financial and Budgetary Impacts

  • The amendment provides an additional $3,000,000 for multimodal improvements.
     
  • The Portland Bureau of Transportation will over match the grant with an additional $994,000 from the Transportation System Development Charge fund and $1,900,000 of ARPA funds from 82nd Avenue.
     
  • Costs for this project will be posted to PBOT Capital Project T00710, which is included in PBOT’s FY 23-24 budget and five-year CIP forecast.

Community Impacts and Community Involvement

  • To date, the project has had one open house and has sent mailings to the project area neighbors with project information that includes an interactive map. A project website also has a sign-up feature so people can receive updates.
     
  • Given the nature of the proposed improvements, which includes primarily sidewalk infill and neighborhood greenway improvements, negative community impacts are not anticipated.

Financial and Budget Analysis

This action authorizes amendment to the IGA between the City of Portland and ODOT for the Jade and Montavilla Multimodal Improvements Project. The amendment authorizes acceptance of additional ODOT grant funds of $3 million, which PBOT will match with an additional $994,000 in Transportation SDC funds and $1.9 million of 82nd Avenue ARPA funds.
