Emergency Ordinance

*Accept and appropriate a grant for $50,000 in FY 2023-24 from the U.S. Department of Homeland Security, Federal Emergency Management Agency, Fiscal Year 2023 Cooperating Technical Partners Program – Regional

The City of Portland ordains:

Section 1. The Council finds:

  1. The City applied to the U.S. Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Fiscal Year 2023 Cooperating Technical Partners (CTP) Program–Regional on April 11, 2023.
     
  2. FEMA has notified the City that it will award a grant to the City in the amount of $50,000.
     
  3. FEMA will reimburse the City a maximum of $50,000 for approved program expenses incurred by Portland Bureau of Emergency Management (PBEM) for grant-related activities during the lifetime of the grant.
     
  4. The grant period is September 20, 2023, through October 19, 2027.
     
  5. No match is required by this grant.
     
  6. The window of time in which this grant may be accepted is shorter than the process required of a non-emergency ordinance, necessitating an emergency ordinance.

NOW, THEREFORE, the Council directs:

  1. The Mayor is authorized to accept on behalf of the City a grant from FEMA for the Fiscal Year 2023 Cooperating Technical Partners (CTP) Program – Regional in the amount of $50,000 and to execute a grant agreement with the United States of America acting through its Department of Homeland Security.
  2. The FY 2023-2024 budget is hereby amended as follows:

  3. The Office of Management & Finance Grants Division is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Mayor’s behalf.
  4. The Director of PBEM is authorized to execute and amend Intergovernmental Agreements, contracts, grants, and memoranda of understanding as required to complete activities authorized by the grant award. 
  5. The Director of PBEM is authorized to execute amendments to the Fiscal Year 2023 Cooperating Technical Partners (CTP) Program – Regional, # EMS-2023-CA-05004, provided the amendments do not increase the City’s financial obligation or risk. Any modifications that increase the City’s financial obligation or risk must be authorized by Council.

Section 2.  The Council declares that an emergency exists because a delay would jeopardize the award of grant funds from FEMA; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

This ordinance allows the Portland Bureau of Emergency Management (PBEM) to accept and appropriate the grant for FY 2023-24 from the U.S. Department of Homeland Security, Federal Emergency Management Agency, Fiscal Year 2023 Cooperating Technical Partners (CTP) Program – Regional.

With these funds, PBEM will update the hydrological and hydraulics model of the Johnson Creek Watershed to better understand and predict flood impacts to residents; improve flood alert and warning; inform updates to floodplain regulations; and identify the most impactful mitigation opportunities.  

The project will have the following benefits:

-Improve alert and warning for flood events, especially for houseless populations (outreach workers alert houseless campers when flooding is predicted).  

-Improve targeted outreach to housed residents who may experience flooding.  

-Allow accurate and targeted strengthening of development codes while supporting additional mitigation tools and opportunities.

-Permit the City to plan future flood mitigation and restoration projects for greatest effectiveness and maximum risk reduction. 

-Advance implementation of mapping requirements of the FEMA BiOp by developing model parameters that reflect best available flow frequency data that includes climate change.

The City has a strong record of floodplain mitigation along Johnson Creek.  The data from a new floodplain model would yield actionable data for emergency responders, outreach workers, and floodplain managers.   

Financial and Budgetary Impacts

This action will increase PBEM’s Grant Fund appropriation by $50,000 for FY 2023-24. There is no match required by this grant. The Grant number is EM000076.

Community Impacts and Community Involvement

This project will directly support the emergency response for the most vulnerable populations of Portland, those without permanent housing and living in the floodplain. Beyond the houseless, more people (approx. 10,000) live in the Johnson Creek floodplain than any other floodplain system in Portland, 47% of which are low income and nearly 40% of which are renters. Johnson Creek has the highest percentage (37%) of people of color living in the floodplain in Portland. The communities that will receive the most immediate benefit from this project will be houseless residents, who are very underserved and face the most extreme risks from flood.  Reductions in flood risk through improved zoning and development requirements and prioritization of floodplain restoration projects and other advanced flood mitigation strategies will reduce the flood insurance burden on the highest percentages of low-income households, renters, and people of color living in the floodplain in Portland.
