Authorize lease extension with Multnomah County for family services space at 10225 NE Gateway Ave with an estimated annual cost of $175,246 (amend CLM Contract 10064, formerly MM C52141)

Passed

The City of Portland ordains:

Section 1. The Council finds:

  1. In 2003, the Office of Management and Finance-Facilities (“Facilities”) entered into a lease agreement with Multnomah County (“County”) at 10225 NE Gateway Avenue, more commonly known as the Gateway Children’s Center (“GCC”), for space for the Portland Police Bureau (PPB)’s Detective Division (“Division”) Family Services Unit (“Unit”).

  2. The lease was amended several times to continue the co-location of organizations to improve and enhance a coordinated response between domestic violence community-based services, law enforcement and prosecution agencies.

  3. The Unit holistically approaches survivors with a victim-centered philosophy to minimize harm and vicarious trauma.  The Division’s investigative focus is violence within domestic relationships, children and the elderly community, balancing the impact to survivors, while utilizing victim assistance services with its community partners.  This unit consists of the Special Victims Unit (“SVU”) and the Child Abuse Team (“CAT”).

  4. SVU is a unique collaboration between PPB, the Multnomah County Domestic Violence Crisis Response Unit (DVCRU), Multnomah County Domestic Violence Enhanced Response Team (DVERT), Multnomah County Sheriff’s Office (MSCO) and other community partners.

  5. CAT is one member of a Multi-Disciplinary Team (“MDT”) that includes the District Attorney’s Office, Department of Human Services, Cares Northwest and others with shared goals to provide information to the involved agencies in a coordinated and efficient manner.

  6. City Binding Policy ADM 13.01 directs bureaus to locate their operations in City owned or controlled facilities when these facilities reasonably meet the business need of the bureaus.  Resolution No. 37017 reaffirmed ADM 13.01 and directed OMF to work with bureaus to fully implement relevant policies by bringing City operations back into City-owned facilities when cost effective to do so, and to bring leases or rental agreements to Council for approval.

  7. OMF has strategically assessed its operational needs and have concluded there are no viable options within City-owned facilities to provide sufficient space to accommodate PPB’s current space needs.  OMF wishes to support PPB and facilitate a lease extension for approximately 8,725 square feet of space with the County, for fiscal year 2023-24, at commercially reasonable rental rates and terms.

  8. The expected financial impact for the first year is estimated at $14,603.83 monthly which is already built into the budget for FY 2023-24.

NOW, THEREFORE, the Council directs:

  1. The Chief Administrative Officer or designee is authorized to execute a lease amendment  consistent with Section 1 findings, all documents will be reviewed by the Office of Management and Finance’s Planning and Portfolio Management team for commercially acceptable terms and conditions.  The Chief Administrator Officer or designee is further authorized to execute additional lease extension(s), provided it is determined that there exists a continued operational need and no viable options within City-owned facilities are available to accommodate the tenant bureau, and provided there is sufficient appropriation budgeted for the lease extension(s).  All lease extensions and related documents shall be approved as to form by the City Attorney prior to execution.
  2. The Mayor and City Auditor are hereby authorized to pay from the Facilities Services Fund when demand is presented and approved by the proper authorities.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Auditor of the City of Portland
