*Authorize Portland Housing Bureau Director to execute grant agreements up to $100,000 to further City housing policies, programs, or activities
The City of Portland ordains:
Section 1. The Council finds:
- The Portland Housing Bureau administers funds that come from various local funding sources, including City, state, federal, and foundation funds allocated to the Portland Housing Bureau’s budget; and
- The Portland Housing Bureau regularly grants funds to public bodies, nonprofit and for-profit organizations, and individuals to support and stimulate programs and activities that are intended to serve the housing needs of the residents of Portland; and
- To protect the City and public’s interest in these funds, the Portland Housing Bureau awards these funds to grantees through written grant agreements that impose grant conditions and allow the Portland Housing Bureau to monitor the grantee’s performance and use of grant funds and to enforce the grant conditions; and
- To increase the Portland Housing Bureau’s speed, efficiency, and effectiveness in providing essential grant funding for programs and activities that serve the housing needs of the residents of Portland, it is in the City’s interest to authorize the Director of the Portland Housing Bureau to execute grant agreements up to $100,000 regardless of funding source.
NOW, THEREFORE, the Council directs:
- The Director of the Portland Housing Bureau is hereby authorized to execute, amend, and terminate grant agreements, as described in PCC Subsection 5.33.030 A.6. as amended from time to time, including subrecipient agreements and intergovernmental grant agreements, up to $100,000 when Council has allocated such funding in the budget of the Portland Housing Bureau or by special appropriation, for the purpose of furthering the City’s housing policies, programs, or activities.
Section 2. The Council declares that an emergency exists because delays in the release of grant agreements would deprive citizens of the benefits these grant funds provide; therefore, this Ordinance shall be in force and effect from and after its passage by Council.

Purpose of Proposed Legislation and Background Information
- This legislation has been proposed to extend signature authority to the Housing Director for all PHB grant agreements regardless of funding source that are under $100,000 in value.
- Adopted in 2003, Ordinance No. 177817 authorized the Commissioner of Public Works to delegate the signing of federal subrecipient contracts valued up to $100,000 to the Director of the Buruea of Housing and Community Development. This ordinance expands this authority to non-Federal funding sources, as the Bureau’s budget has shifted and expanded over the years since Ordinance 177817 was promulgated in 2003.
- This legislation does not impact existing City policies.
- All locally-funded grant agreements or Federally-funded subrecipient agreements that are over $100,000 will continue to be brought before Council for approval.
Financial and Budgetary Impacts
There are no long- or short-term financial impacts to the City arising from this action. This action does not have any budget impacts and does not change City expenditures, revenues or staffing.
Community Impacts and Community Involvement
The Housing Bureau regularly consults with the community about its programs, and the program design and structure is informed by those consultations. The Portland Housing Advisory Commission, the Fair Housing Advisory Commission, the Renter Services Commission and the North/Northeast Strategy Oversight Committee all contribute to the design and implementation of programs that are granted to local agencies or other jurisdictions to carry out. The public also is consulted at open hearings during the federal grant consolidated planning process.

This action has no impact on the City’s total or renewable energy use.
Financial and Budget Analysis
This ordinance extends the Housing Director’s signature authority for grant agreements up to $100,000 to also include non-Federal funding sources. This action has no fiscal impact as this authority only extends to situations where Council has already allocated funding.
